Breathalyzers for puplic intoxication?

I have a quick question for anyone with legal expertise. Long story short...Friend was riding his bike home after having drinks (One beer and two shots) late last night. The roads near town are not very bike friendly and he decided to ride on the sidewalk instead. He didn't realize that there was no indentation to access the sidewalk, so he hits the curb and falls off the bike.

Police see him, approach, and asks how much he had to drink. He was taken to jail for public intoxication. My question is....Should he have been given a test to determine how much alchohol he had had? No tests of any kind were administered. Ok....I'll wait for your responses and I thank you in advance.
