Breathalyzers for puplic intoxication?
I have a quick question for anyone with legal expertise. Long story short...Friend was riding his bike home after having drinks (One beer and two shots) late last night. The roads near town are not very bike friendly and he decided to ride on the sidewalk instead. He didn't realize that there was no indentation to access the sidewalk, so he hits the curb and falls off the bike.

Police see him, approach, and asks how much he had to drink. He was taken to jail for public intoxication. My question is....Should he have been given a test to determine how much alchohol he had had? No tests of any kind were administered. Ok....I'll wait for your responses and I thank you in advance. hi

I am pretty sure it depends on the state.

The vast majority of states do not require a breathalyzer for drunk in public. It is solely on the officers discretion if you are falling down, causing problems, if you are endangering yourself or others.

Sounds like if your friend wants to hire a lawyer he could get off. Stating that the traffic was not safe for biker travel and the sidewalk had a curb etc.... May cost more for the lawyer than the actual fines but bets 6 month jail or probation with mandatory AA meetings.
