Zimmerman trial....missed points and logical conclusions.
First of all, in the thread entitled....Judge In Zimmerman Trial To Allow Toxicology Report Showing Trayvon Used Marijuana.

I have yet to hear the words (or phrase) paranoid behavior.

As a former marijuana smoker I realized that sometimes, for no real reason, I have become paranoid.

Paranoid behavior is not exclusive to smoking weed, but from my personal experiences, smoking pot does enhanced this particular feeling. This, of course, goes to T.M. having trace amounts of THC in his system.

Having even trace amounts of an illegal substance(s) in ones system is enough to raise legal issues in the state of Florida in that the mental faculaties of those concerned is usually brought into question.

This whole episode is crazy. If the prosecution has it's way, individuals (and people sworn to uphold vigilant watch) are at risk from any suspicion of due force for doing exactly what they have the duty to do.

Trayvon Martin, while his death is tragic, did not need to challenge George Zimmeron. George Zimmeron, in his watch did not need to challenge Trayvon Martin.

Watch and report.

Watch and report is exactly, imo, is exactly what Zimmeron was doing until....yes...a paranoid Martin found himself being "followed by a creepy ass cracker".

Defense just got a huge victory in my opinion.

If the prosecution has it's way then it will be legal to beat someone just for looking at you.....yet illegal to defend ones' self from the beating taking place. The state of Florida has screwed themselves.

Just some thoughts.

trayvon was probably so high that he thought someone with a gun was following him.

he may have even thought the guy called the cops on him too.

Thus giving him the right and obligation to beat up said person.

So.....having a thought is entitlement to an act of aggression?

Thanks for sharing.

Nice analysis, good break down for us 'layman', and yes, Florida has backed themselves into a corner. Imagine not only the amount of crime increasing but the violence also becoming a factor that emboldens criminals, because they can beat assault in court.

The fact that you're paranoid doesn't mean that no one's after you. :) But jokes aside.

Pot doesn't cause aggression, but fear certainly does. Basic fight or flight response.

Pot induced paranoia most likely caused him to attack Zimmerman.

Very good points, OP. I had one friend who did get extremely paranoid on it.

One thing though that I haven't heard that might make a difference is does the amount found during the autopsy indicate he smoked it that same night for sure? I don't know one way or the other. I know it stays in the system for weeks but by the amount found they should know if he smoked it that same night shouldn't they?

Or was this already covered and I missed it?

Sorry to say but in a mutual combat situation if you kill somebody it is murder.

If travon was acting because he was in fear for his life at the time he attacked george zimmerman because of an action zimmerman made then it is murder. You do not have the right to stalk anyone unless you are law enforcement. streets are public property, and even if he crossed private property that is not illegal unless posted.

On that note the State has the burden to prove murder beyond a reasonable doubt... the defense does not have to prove innocents they are innocent until the state proves otherwise..

Smoking weed should not be brought into the trial unless the proper mouth swab was done . At that point they can say the thc wasnt from up to three weeks prior. Residue in the mouth is only there hours or the day of smoking it.

2nd degree charges were ludicrous, what 'criminal' ever makes 911 and 311 calls BEFORE he commits a crime? The defense should emphasize this.

Fox News was reporting earlier today that the use might have been 3-5 hours prior...but that there was something in the tox report which also indicated habitual use over a long period. I didn't catch all the details so I don't know how reliable the info is....We'll probably find out tomorrow during the trial.

Sorry.. you do not know the law at all... THERE IS NO CRIME AGAINST FOLLOWING SOMEONE....Unless there is a current restraining order.. There is a crime against putting your hands on another human being without their permission.. Only idiots think that you or anyone has a right to touch another person for following them

Zimmerman did not have a tests for drugs and or alcohol and he shot and killed Martin. Justified or not... not screening the killer of a youth or anyone else is weird. Was surprised Judge Nelson admitted Martin's tox screen into evidence being that Zimmerman was not screened.

I'm not an expert, nor do I claim to be even moderately educated in the field of toxic forsensics, however I have heard that drug use is (or can be) apparent in hair samples.
Thus, Zimmeron's hair can still be analysised at this late date.

*edit* It may not be brought before a jury, but scientifically it is still possible.

Second degree murder is out...no way on earth the jury can find the elements of ill-will, spite and hatred.

Those elements simply are not founded in the States' case.

Manslaughter, in the state of Florida, according to law, is a whole different animal.

Defense counsel has been great so far, however, not bringing up a paranionia claim thus far is a bit concerning. I'll be shocked if it is not brought up tomorrow.
