U.S. Senate Bill 517 and U.S. House Bill 2995, a bill that would allow experimental weather modification by artificial methods and implement a national weather modification policy, does not include agriculture or public oversight, is on the “fast track” to be passed in 2006.

This bill is designed to implement experimental weather modification. The appointed Board of Directors established by this bill does not include any agricultural, water, EPA, or public representatives, and has no provisions for Congressional, State, County, or public oversight of their actions or expenditures.

Weather Modification may adversely impact agricultural crops and water supplies. If the weather is changed in one state, region or county it may have severe consequences in another region, state or county. And who is going to decide the type of weather modification experimentation and who it will benefit or adversely impact?

This experimental weather modification bill will impact residents across the United States not just in California. Many current and ongoing weather modification programs (80 listed by NOAA in 2005), including the one in Wyoming that is designed to increase the snowpack, may be diverting rainwater away from Oklahoma and Texas, two states that are currently fighting fires caused by a lack of rainfall. We have no idea what the unintended consequences of the Wyoming action or other experimental weather modification programs might be now or in the future.

In addition to the experimental weather modification programs listed by NOAA, there are both private and ongoing government sponsored atmospheric testing and heating programs underway in Alaska and across the United States. Alaska Senator Stevens recently received $50 million in funding for Alaska’s atmospheric heating program.

All of these unregulated, private, government, and public weather modification programs, may also have unintended synergistic effects. Senate Bill 517 does not address these issues but intends to implement more experimental weather modification programs without a national debate or public oversight.

Artificial weather modification can impact all of us by reducing water supplies, changing agricultural crop production cycles, reducing crop production, and water availability. Since most experimental weather modification programs use chemicals released into the atmosphere the public could be subjected increasingly toxic or unknown substances that could adversely impact agricultural crops and trees.

Trimethyl Aluminum (TMA) and barium are just two of the toxic chemicals used in recent atmospheric heating and testing programs according to NASA. The Alaska H.A.A.R.P. atmospheric heating program may have the capability of changing the Jet Stream which could also change our weather.

Before the government can start spraying us with Chemtrails they will be required to complete an a full environmental assessment with the associated Environmental Impact Statement (EIS) as required by federal statute under the provisions of the National Environmental Protection Act(NEPA), which requires a full EIS for all major federal projects and activities.

Weather Modification Research and Technology Transfer Authorization Act of 2005 - Establishes in the Department of Commerce the Weather Modification Advisory and Research Board to promote and fund research and development (R&D), studies, and investigations with respect to: (1) improved forecast and decisionmaking technologies for weather modification operations, including tailored computer workstations and software and new observation systems with remote sensors; and (2) assessments and evaluations of the efficacy of weather modification, both purposeful (including cloud-seeding operations) and inadvertent (including downwind effects and anthropogenic effects).

Establishes within the U.S. Treasury the Weather Modification Research and Development Fund. Directs the Board, unless the use of the money is restricted or subject to any limitations provided by law, to use amounts in the Fund to: (1) pay its expenses in the administration of this Act; and (2) provide for R&D with respect to weather modifications by grants to, or contracts or cooperative arrangements with, public or private agencies

REGULATORY IMPACT STATEMENT

In accordance with paragraph 11(b) of rule XXVI of the Standing Rules of the Senate, the Committee provides the following evaluation of the regulatory impact of the legislation, as reported:

NUMBER OF PERSONS COVERED

The bill would require OSTP to develop a national weather modification policy. The bill would not authorize any new regulations and, therefore, would not subject any individuals or businesses to new regulations.

ECONOMIC IMPACT

S. 517 would not have an adverse economic impact on the nation's economy. The Act would not authorize any new spending.

PRIVACY

The reported bill would have little, if any, impact on the personal privacy of U.S. citizens.

PAPERWORK

The reported bill would not increase paperwork requirements significantly for individuals and businesses. Section 4 of the Act would require OSTP to submit a 10-year plan to Congress and an annual report to the President and Congress.

SECTION-BY-SECTION ANALYSIS
Section 1. Short title


Section 1 would establish the short title of the bill as the `Weather Modification Research and Development Policy Authorization Act of 2005.'
Section 2. Purpose


Section 2 would establish the purpose of the bill to develop a comprehensive national weather modification research policy.
Section 3. Definitions


Section 3 would define various terms in the act, including `Board', `Research and Development', and `Weather Modification.'
Section 4. Weather Modification Subcommittee


Section 4 would create a subcommittee in OSTP to coordinate a national weather modification research program. The subcommittee would be co-chaired by NOAA and NSF, and would have representation from NASA and other appropriate Federal agencies.

The section would require the Subcommittee to submit a plan for weather modification research that would describe goals and activities, evaluate existing programs, make suggestions on coordination with existing programs, and provide an estimation of Federal funding for weather modification research.

The section states that the program may include activities to improve the understanding of processes related to weather modification including cloud seeding, cloud modeling, improved forecast technologies, as well as the potential negative impacts of weather modification.

Finally the section would require the Board to submit an annual report on the activities conducted pursuant to this section.
Section 5. Weather modification research advisory board established


Section 5 would establish an advisory board in OSTP to make recommendations to the Weather Modification Subcommittee. The board would be composed of outside experts including scientists, engineers and State officials involved in weather modification operations. The board would examine potential uses for weather modification research and would evaluate the efficacy of weather modification research.
Section 6. Cooperation with Weather Modification Subcommittee


Section 6 would instruct Federal agencies to cooperate with the Weather Modification Subcommittee.

CHANGES IN EXISTING LAW

In compliance with paragraph 12 of rule XXVI of the Standing Rules of the Senate, the Committee states that the bill as reported would make no change to existing law.
