Then as a public servant recognizing his duty to protect someone under the influence (with slippery stockinged feet) his job was to be the adult and WALK her to the bench. No doubt she was PROPELLED a good 8 feet into the cell. You lose. Try again. |

Maybe in Canuckistan. Here in the US, you could be sitting drunk in your car in your driveway , never having driven off while you were drinking, and it is still legally considered drunk driving. Same here, at least in BC. Even if you choose to pass out in your vehicle instead of driving home or sleeping on the street, you can get a DUI. The logic behind that is that you could wake up still under the influence and then drive. But it's illogical because anyone can wake up hung over in their home and go out driving too. The situation does require some analysis though. She is very likely drunk. This probably made the fall more likely to happen and the impact worse as she was less likely to put her arms up in defense. Consider the situation and the similar situations they see regularly. If we don't extreme behavior from the police, we can't be so extreme in punishing their mistakes. For Heaven's sake, if he knew she was drunk he did not have to shove her into the cell the way he did..She is a small woman not a 250 pound man..Come to think of it, if it had been a man he probably would have thought twice about pushing him. People who act like 'savages', will pick up on these signs of vulnerability and become empowered by it. And that is exactly what happened with Officer Hart. The reason she "resisted" going back into the cell wasn't because she didn't want to go back in. It was because she was being denied her connection to her family via her rightful phone call. Obviously she said of did something while outside the cell that triggered Officer Hart's "savage side". He knew the layout of the cell. He knew where her head was going to land. He envisioned it a spit second before he created the situation. Her vulnerability fueled his rage. His follow through is impressive, much like a baseball pitchers. |
