here's how it should go:

cop: have you been drinking tonight?

driver: naahhhh not me mate! well maybe a couple eh!

cop: blow into the tube until the machine goes beep please

driver: blow blow blow beep

cop: either: okay you're free to go

or: you are under arrest for the purpose of further breath analysis. get out of the car please.

The humiliation of going through that might be a much stronger deterrent to preventing someone from being a repeat offender. The attire she is wearing is irrelevant to the situation - otherwise that might suggest that if you're 'underdressed' then you automatically go through a different process than someone who is drunk driving while dressed normally.

Given her state of dress, my concern would be this girl was in a bad situation; being taken advantaged of at a party or someones house, potentially raped, and was trying to escape. She was inebriated and being pulled over only added to the overwhelming gravity of the situation making her even more frightened.

not all cops are scum. this officer is following proper field sobriety test protocol and treated this girl like he would have treated any other pulled over in the same situation.

The test are designed for failure to build even more of DUI case never ever agree to do a field test it is your right not to. I challenge any stone cold sober person to try it at night along side the road with the flashing lights and a flash light in your face and a prick cop.

Now to girl can sue. It was all planned between this cop and the female. After she sues and gets rewarded she will be giving some to the cop. I bet the cop lost his pension and figures this is the only way out.

That cop seemed nice to me.

The girl, however, seemed vapid as shit and I think she was trying to seduce him TBH. She was deliberately making her shirt pull up between the tests to reveal her panties, or it seems that way to me. I'm a girl myself and I have never been in a car with someone that had been drinking BUT I have seen girls try to weasel their way out of tickets or public intoxication charges by playing dumb and highlighting their feminine assets to the police officer....it works a lot of the time.
