Judge Napolitano on SC’s Anti Obamacare Bill: “If enough states do this, it will gut Obamacare”
Judge Andrew Napolitano said South Carolina has the Constitutional right to pass a bill that would essentially nullify or eliminate Obamacare. The bill, entitled “South Carolina Freedom of Health Care Protection Act,” was voted on and passed by a 65-34 vote in the state House of Representatives last April. Now, it moves on to the Republican-controlled state Senate that will be fast-tracked and could quickly be signed into law by South Carolina Governor Nikki Haley.

It may be one of the very few things that Republicans and Democrats, liberals and conservatives, Left and Right can agree on: ObamaCare has been an embarrassing series of rolling disasters since it stumbled out of the starting gate on October 1. From the non-functional Healthcare.gov website fiasco to the cancellation of millions (soon to be tens of millions) of existing health insurance policies to the heart-stopping sticker shock on replacement policies, the Patient Protection and Affordable Care Act (ACA) has drawn brickbats from critics all across the political spectrum.

“Reid said he thinks the country has to ‘work our way past’ insurance-based health care,” the Sun reported. “What we’ve done with Obamacare,” Reid said, “is have a step in the right direction, but we’re far from having something that’s going to work forever.”

When then asked by the PBS interviewer whether he meant ultimately the country would have to have a healthcare system that abandoned insurance as the means of accessing it, Reid replied: “Yes, yes. Absolutely, yes.”

“We had a real good run at the public option — don’t think we didn’t have a tremendous number of people who wanted a single-payer system,” Reid said, referring to the contentious battles over ObamaCare.

SCHULTZ: Finally, is this Kennedy-like? You didn't get everything, but you got a great start. And you got some great things, and – that was kind of his philosophy. Take what you can get and move it forward.

NANCY PELOSI: Oh, well, we got much more than that. We got much more than that. Yes, Teddy was the person who said, 'you have to – you have to see a victory and recognize it when it is in sight.'

I wanted to have a bill that accomplished the same things as a single-payer or a public option would do. Even if we couldn’t get the votes in the Senate to do the public option. And I believe we did that. I think we would have saved more money if we had the public option and I think that -- but I think that our purposes are served by this. And if it enabled us to go forward, then so be it. One of these days, I still believe that we can -- the decision, the judgment will be made, maybe by states about their doing single-payer on their own and the rest. But in the meantime, as far as meeting the needs of individuals and families there, and as I keep saying, as far as our families are concerned, the best is yet to come.

Of course nothing SC's government can do would keep the Federal government from holding insurance companies up to the standards specified in ACA. Nor would anything SC could do stop people from signing up for insurance through the Federal exchanges or keep people from receiving their subsidies or getting their claims paid.

It's again more empty, money and time-wasting posturing from Republicans who know better.

And before that, Harry S. Truman made a push for it back in 1947, which was opposed by the AMA.

When the term "socialized medicine" first appeared in the United States in the early 1900s, it bore no negative connotations. Otto P. Geier, chairman of the Preventive Medicine Section of the American Medical Association (AMA), was quoted in The New York Times in 1917 as praising socialized medicine as a way to "discover disease in its incipiency," help end "venereal diseases, alcoholism, tuberculosis," and "make a fundamental contribution to social welfare."[20] However, by the 1930s, the term socialized medicine was routinely used negatively by conservative opponents of publicly funded health care who wished to imply it represented socialism, and by extension, communism.[21] Universal health care and national health insurance were first proposed by U.S President Theodore Roosevelt.[22][23][24] President Franklin D. Roosevelt later championed it, as did Harry S. Truman as part of his Fair Deal[25] and many others. Truman announced before describing his proposal that: "This is not socialized medicine".[21]

Government involvement in health care was ardently opposed by the AMA which distributed posters to doctors with slogans such as "Socialized medicine ... will undermine the democratic form of government."[26] According to T.R. Reid (The Healing of America, 2009):

Even if they did reverse it, the massive increases in insurance premiums will remain. As soon as Obamacare was first mentioned, we had the highest increases in the history of the company. Now its a run a way train.

This all feels very dangerous and unpredictable.

Encouraging at first, but the single payer card lurking, I get a very bad vibe about how it's going to turn out.

Last night some poster asked the MODS to embed the link from ehealthinsurance.com so everyone doubting this cansee first hand how much their monthly premiums will increase under 0BungoCare. It shows the 2013 pre ObungoCare rate and the 2014 post ObungoCare. It is beyond sick!

2013 before ObungoCare rate= $139
2014 AFTER OBUNGOCARE rate = $406

That is a 140% increase in a single year.

Phnom, can you help out?

I think the judge is one of the smartest people in America right now, but I doubt that this "nullification" will work. I don't see it holding up in court. It's a great symbolic gesture, but it wont change anything. I hope I'm wrong!
Hope for the best, but prepare for the worst.

Colorado also voted to usurp federal law by legalizing pot. So-called "sanctuary cities" usurp federal law every day by harboring illegal aliens. what SC is doing is really no different.

for those of you who used to have insurance, it was good wherever you went for the most part.

for those of you who intend to apply for Owastocare, you will have HMO care, available locally, limited to lowest pay contract winners.
You will have no other access anywhere else, you will have no choice, you will get care that if poor previously when you had a choice, will get much much worse since anyone with skills enough to bypass serving the system will opt out.

Owastocare is a Potemkin village, or more properly a Potemkin hospital which is all facade and no substance.

You will pay through the nose for a prop that will control and criminalize you as you seek to bypass the system for any personal benefit.
