Man put on trial after police kicked down his door without warrant, tased wife & roommate


COTATI, CA — A couple and their roommate were violently tased and arrested when police officers broke down their front door in response to a noise complaint. Despite the shocking video that captured the incident, the police were cleared for breaking into the home and assaulting the 3 occupants, and instead one of the victims was put on trial.

The incident took place on May 10th, 2013, when a neighbor called the police because of allegedly hearing “yelling and sobbing” coming from the residence next-door. Police were sent to investigate at 3:48 p.m.

The residents, James Wood, 33, and his wife Jennifer, 29, admittedly had a loud argument in the backyard, but did not become violent and did not know that a nosy neighbor had phoned the police. They reportedly argued about whether to spend their tax refund money on fixing their car or buying a new one.

The couple’s roommate, James Helton, 32, was inside putting the Woods’ 2-year-old daughter down for a nap when the Cotati Police arrived, with guns already drawn. Helton summoned his roommates and the three began talking to the police through a window.

“We had our hands up against the glass. We were more than happy to talk through the glass, or he can have dispatch call our cellphones,” Helton later explained. “(An officer) became agitated and said, ‘No you’re going to do what I tell you to do.’ “

And this is yet another example of why you should have guns/rifles in your home and use them on such people who enter your home in such a way.

If this was my home, there would have been some dead cops and most likely myself would be dead as well...

The real bad guy in all of this is the nosey neighbor who called the police in to begin with!

The cops were just doing their jobs -- they get a report of a domestic disturbance occurring, they HAVE to go inside to make sure nobody is dead, being held hostage, etc.

If they had just cooperated they wouldn't have gotten their asses kicked by the cops.

If there is the sound of fighting coming from my house I would welcome the police dropping by to see what's going on. And I would want them to come inside to assure that everything is okay.

In a case like that it's considered 'exigent circumstances' -- that means that a person's life may be in danger, so they do not need a warrant to come inside.

And it means you have no right to not allow them inside. They ARE coming inside, whether you like it or not, so might as well just do it the easy way and let them in. Or they will kick in the door, then kick your ass.

I think the idiot talked to them thru the door, told them that everything was okay and that he didn't want them to come inside, just wanted them to take his word for it.

WRONG ANSWER. If cops are called to your house because of a disturbance they are required to go inside and see for themselves that everything is "okay." They aren't taking your word for it -- how do they know you're not holding a child hostage or something?

Same thing with dialing 911 by accident. You can't just say, "I dialed it by accident, it's okay" -- they HAVE to come inside and search your home and verify that. You can do the right thing and just let them in, or they can kick in the door, kick your ass, then arrest you for interfering with a peace officer. Your choice.

Back before people went crazy, if a cop knocked on your door, you stepped outside or even invited them in to see what the problem was...I've done it and had no problems.

Just last summer before leaving for work there was a knock at the door, I opened the inside door leaving the security door still locked.

A sheriff was standing there with papers and asked if I was so and so...I said no, and then I opened the second door and asked to see the papers...it had my address but the wrong name, so he apologized and left. I didn't provide ID and he didn't ask...because I wasn't a dick to him.

This is how you handle a situation like this. If it had been one of those "I know mah rights!" morons they would have slammed the door in his face, then would have been whining and crying when a SWAT team showed up later.

Second, I am against anyone that violates my rights that I pay taxes on to uphold and that I hire to represent my rights in Washington. Jury verdict split: 6 to 6...

The account at this link makes it clear that the concern of the cops was not to verify the safety of the inhabitants of the home. Their priority was to make sure their orders were being obeyed.

There is a big difference.

The wife was standing inside the house with her hands up when she was tasered.

There was a 2 year-old who had just been tucked into her bed for a nap that afternoon.

If you had been traumatized like this as a child, you would never forget it.

These cops were on a power trip.

This is why 6 of the 12 jurors sided with the man who was accused here.

And I think the publicity around this case will ensure the prosecution drops the case and does not go for a retrial.

In fact, a letter to the D.A. might be more helpful than writing a comment here. Yup, I do that kind of thing, don't you?

In the video, police officers are seen forcing entry into the home. After an officer grabs his wife’s arm, Wood is heard to yell, “You are assaulting her.”
An officer immediately fired his stun gun at Wood, hitting him five times.

Glorious & Marvelous Mistrial in the case of James Wood, the Cotati resident whom misguided D.A. Jill Ravitch mistakenly prosecuted for protecting his wife and family against the excess and abuse of force by police, including the assault of his wife. Suggestion: Drop the case. Thousands more people are learning about this illegal arrest and prosecution every day. I think civil law suits are great. They last for years and years. Wow, how financially draining! Whom will Mr. Wood sue? Just Sonoma County, or prominent individuals and employees of the County who are part of this farce? So many jobless in America. Do they include former District Attorneys? If the pigs wanted to get past the Constitution and get in your house for an illegal search, what is to stop them from just claiming they had a call or reporting a "disturbance" themselves? Whats to stop the pervert next door from claiming to hear a disturbance to get revenge? Would that not be a negation of Constitutionally guaranteed rights?
