Sorry about your daughter, .....please do this quickly, get all records, surgical notes, most important.....labs....any tests they have done prior and afterwards...make sure to get copies of anything she has done on a daily basis.....start a file..... Dr notes, labs, and surgical notes can disappear fast and from the sounds of it they could......if dr quit the next day , it might imply he knew of his mistakes or the nurses may of went to the board.....for whatever reason sounds like he didn't do his job and now your daughter will suffer greatly.....

Yes what your referring to is a power of attorney. It will be necessary for anyone other than the patient to get access to those medical records.

I would save going to law enforcement until after I contacted an attorney. You will have to file paperwork and to get them to track this guy is going to take a little bit of pressure from what I've seen. You need to be quick about it because I've seen these SOB's up and disappear or go back to there home country and become pretty much untouchable at that point.

If she is doing well enough to be moved to a regular room soon, then she can sign her name to a ROI (Release of Information) document and obtain the records for herself. Her nurse should have one on the ward or can request one from medical records. You do not have to be her POA if she is able to sign the paper and is competent to do so.

Hope the best for your daughter. Any surgery can have complications, but this sounds excessive even for a messy surgery like one for endometriosis.

If he quit the next day, there must be a reason. Was this her regular OB/GYN?
If he has a h/o poor outcomes or substance abuse, then there is already a paper trail on him and your daughter may have been the last straw. In this day and age, nurses and support staff will usually quickly "out" an impaired provider. Maybe he/she knew this.

Even if he/she retired from medicine, they will have a malpractice "tail" that should cover them.

Best of luck and a wish for a quick recovery for your daughter.

My career was hosp. admin I know first hand what happens once legal action is a concern. For now be as nice as possible and do whatever you can to get the best care possible for your daughter

I used to work a while back as a nurse in the states and when we were told patients were looking into legal action, nurses were very vigilant about the care they gave. So in a way, that patient kind of got priority care. And that was because as we were told, the fuck up happened in surgery, so they wanted to make sure nothing else happened on the floor.

I believe you are correct about nursing, any hint of legal action admin would advise nursing to be vigilant.

Once legal action is a concern it may not be as easy to find other docs to step in. Also in my experience nurses are the best sources for recommending which doctor to ask for second opinions etc.

My intent was to keep the focus on getting the best medical care. You have a few years to pursue legal action. For now this girl needs good doctors and nurses.

First and foremost your daughter is in my prayers

You need to contact a competent attorney ASAP that specializes on medical malpractice .

You also must understand that hospitals are big business and will do everything to protect themselves .

If you are legal guardian over your daughter you are allowed access to all he r records , go to the hospital and sign the appropriate releases and acquire these ASAP , they may stall and delay this as much as possible .

Again as soon as you read this post start looking fr attorneys , this can not be underestimated or delayed , time is of the essence , this doctor that quit needs to be deposed and questioned by a competent medical attorney , the medical records should all be reviewed and opinions written by consulting surgeons to see where and what mistakes where made .

On a personal note as one who has been partially crippled by the medical field , I am sorry for what your daughter will be forced to go through the remainder of her life , our health is the most important thing one has on earth and most don't realize it until it is taken , God works in mysterious ways , so please keep the faith , it is man who has and will always let you down .

My daughter had surgery for endometriosis this past Tuesday.
She had hoped to have her ovaries left intact but because of the severity of the fibroids (from what I understand) they did a hysterectomy instead. Tried to do it vaginally, couldn't, had to do it abdominally.

Okay, so one of the fibroids was attached to her bladder. In removing it they either cut or tore the bladder resulting in a repair to the bladder and she had to be put on a catheter.

Let me also add here that the doctor who performed the surgery QUIT the day after this surgery. I'd like to know why? Quit voluntarily, let go, or?

She's thinking she'll be able to leave in a couple days but no, not feeling better.

Late last night they did an emergency surgery. Seems the colon had been cut during the initial surgery and had been leaking into her stomach all this time! I'm also told that they removed additional fibroids missed during the first surgery.

They had to remove part of her colon and she now has a colostomy bag in addition to the catheter.

Bladder infections??

Future colostomy???

I also had endometriosis with severe adhesions. This was many years ago. The endo had wrapped around my bowel and adhered to my kidney. I was extremely fortunate and half and ovary was saved.

The doctor said one more day and I may not have made it, as the bowel was almost closed off. Many years of great discomfort due to that.


But nothing got chopped and nothing leaked with me. I did have severe peritonitis. Doctor said my whole innards were full of pus. I suspect it is tricky surgery and every case is complicated in its own way.

I wish your daughter great luck. Lawsuits are really horrible and not very satisfying, in the end. You go in lucking for justice and hopefully walk out with at least your expenses covered.

It sounds like she may have some long term consequences medically, and she should at the very least have her medical expenses covered.

A bad outcome doesn't always equal medical malpractice.

Your daughter could have had a ton of adhesions due to her endometriosis that could have plastered her colon and bladder walls to her uterus.

Damage to the bladder and ureters is a known complication of hysterectomies; damage to the colon, less so, but a risk.

Sounds like you had a pretty average gynecologist operate on your daughter, which isn't surprising because most OB-GYNs are average to terrible surgeons.

This is going to be hard case to prove malpractice on. Sorry this had to happen.

Exactly...document everything! Dates, times, procedures, etc. If I'm correct, the medical records belong to your daughter. IF possible, have her give you the authority to make copies of EVERYTHING up to now and daily. Don't wait and leave it up to a lawyer. You will be one of many clients, and they might skip over essential information.

YOU have to be your own doctor, nurse, and lawyer! I don't know where she is hospitalized, but I'm an RN and research all hospitals and physicians, dentists, etc., before having anyone care for my loved ones or me. You can still do that for any further procedures. In the case of emergencies, I have to admit, I've had to trust whomever is available.

So very sorry to hear this about your beloved daughter. She surely did not deserve this. Sounds to me like the doc came to work either stoned, drunk or higher than a kite....or maybe just plain pissed off at his own wife.(male)thing.

As mentioned already, document everything and contact an attorney. There are usually attorneys who will take a medical malpractice case without charging fees until the case is settled. This absolutely sounds like a case for malpractice, especially with the doctor quitting - that is very suspicious.

Op, good luck and I hope your daughter recovers well.

Speaking from a very similar situation, I had extensive surgery almost 3 years ago to repair/replace a directed aorta. During one of several surgeries, my colan was nicked including my spleen which had to be removed. The contents on my colon leaked for a week before it was detected and only then due to spectic infection and ecoli infection which in it's self all most killed me. For over 2 years I had a "bag" as a result, only a year ago I was healthy enough to have more surgery and have my colon reattached as in my case very little of my colon was removed and it was successfully reattached. (however with a xtensive complications including addtional infections and abcess wound healing). There were other mistakes such as failing to have my blood type on hand prior to surgery and being forced to be given alternative blood type as a substitute.

The biggest issue to get the best Healthcare, second priority is the legal action.

With my situation in a nut shell, I found no attorney that would take my case to court. All stated that that while errors were made, it would be too expensive and too complicated to pursue legally. As a result of my dissected aorta surgery, I'm partially paralyzed, I was hospitalized for over 8 months after the initial issue and yet have been able to return to work.

After losing my career job which I was posed to retire from, my only income now is disability and long term disability with such making up only half my prior income and with no ability to legally pursue the butchers who almost killed me.

As my situation involved medical errors, the general concensus was that should have not recovered from and as a result, those mistakes while they compounded my recovery, I survived so I was not able to file malpractice against the butchers who almost killed me.

It comes down to the fact that in my situation, extensive medical experts would need to testify on my part against the doctors who screwed up, those "experts" are expensive and the attorney's weigh how much such experience needed is against the amount they will receive should they win and in my situation, it was too risky for them to take my case. On top of that, doctors tend to stick together, it's difficult to find one that will go against another in court thus making the series of those who will very expensive.

I was told the only case I would have had is if I had died despite now being disabled and without a job.

Get a good attorney, don't go cheap and do shop around. There is a statue of limitations but you have plenty of time so take care of what really matters which is your daughters health. Document EVERYTHING, write down everything including verbal conversations. Fact are important, document dates, times, all people involved from the doctors, surgeons, nurses to the janitor too!

Btw - stay the hell away from hospitals "general" surgical services, most of my surgical mistakes were made by the unknown general services that come after the major surgery is complete to preform mundane tasks such as closing up after the primary surgeon is done. These "services" are done by undocumented doctors with very little if any documentation later so is very important to document now who was in the surgical room with your daughter as such details will be conveniently lost later and legal action can't be taken unless the names of the people are known.

My situation was complex, I was hospitalized for over 6 months, had over 10 surgeries in a two month period and at one point had less than a 1% chance of survival. My entire aorta had to be replaced which is more complicated than a heart transplant but be prepared to be face every obstacle that the hospital can throw at you and while your daughter in under their care, do not indicate that you may pursue legal action as once they suspect that such, everything they do and and the healthcare they provide changes. Keep your friends close but keep your enemies closer.

My daughter had surgery for endometriosis this past Tuesday.
She had hoped to have her ovaries left intact but because of the severity of the fibroids (from what I understand) they did a hysterectomy instead. Tried to do it vaginally, couldn't, had to do it abdominally.

Okay, so one of the fibroids was attached to her bladder. In removing it they either cut or tore the bladder resulting in a repair to the bladder and she had to be put on a catheter.

Let me also add here that the doctor who performed the surgery QUIT the day after this surgery. I'd like to know why? Quit voluntarily, let go, or?

She's thinking she'll be able to leave in a couple days but no, not feeling better.

Late last night they did an emergency surgery. Seems the colon had been cut during the initial surgery and had been leaking into her stomach all this time! I'm also told that they removed additional fibroids missed during the first surgery.

They had to remove part of her colon and she now has a colostomy bag in addition to the catheter.

Bladder infections??

Future colostomy???

You know from your background that you can have an attorney review those medical records and that they employ nurses in their firms for this. Or, you could just have a disinterested (in the outcome) nurse review them. Probably easier to just turn it over to the office.

Did the doctor also leave town? My God! Try not to worry and just pray and turn it over to God so that you can stay intact so you can function well.

Terrible experience, and I do feel sorry for what your daughter is going through. But seriously, when are people going to learn that cutting shit out of the human body is NOT the way to heal it?

I hate when we don't understand something and assume the only way to stop it is to remove it. Only the symptoms and problems are known about endometriosis, there is no known cure just medicinal and surgical "treatments". I understand the inherent pain involved with this condidtion but to believe cutting away tissues is somehow going to convince your body to stop the pain and symptoms is lunacy.

If the organs, colon, ovaries etc. have become fused together, seperating them with a knife will only cause them to fuse in another position. This is not addressing the underlying cause and is merely giving a false sense of relief which will most definitely be temporary.

Not to mention the intrusive nature of the knife and its ability to cut EVERYTHING, including stuff that was perfectly fine before. Tumors, cysts, lesions etc. are all produced by the body, thus they can be removed BY the body.

What caused them to appear in the first place is the issue, NOT the growth itself. Cutting them out doesn't stop the source.

The surgery wasn't done in a private clinic owned by this doctor, so your daughter's attorney will file a law suite against hospital. Hence, this doctor could face disciplinary action by the board and may have his license suspended for some time. It's like a disaster to any doctor's carrier.

This could become 3-4 years "battle", so look for a lawyer who'll work on contingency. If he/she has a strong cases then it can be settle without going to court. Hospitals want to keep their reputations...
