My daughter had surgery for endometriosis this past Tuesday.
She had hoped to have her ovaries left intact but because of the severity of the fibroids (from what I understand) they did a hysterectomy instead. Tried to do it vaginally, couldn't, had to do it abdominally.

Okay, so one of the fibroids was attached to her bladder. In removing it they either cut or tore the bladder resulting in a repair to the bladder and she had to be put on a catheter.

Let me also add here that the doctor who performed the surgery QUIT the day after this surgery. I'd like to know why? Quit voluntarily, let go, or?

She's thinking she'll be able to leave in a couple days but no, not feeling better.

Late last night they did an emergency surgery. Seems the colon had been cut during the initial surgery and had been leaking into her stomach all this time! I'm also told that they removed additional fibroids missed during the first surgery.

They had to remove part of her colon and she now has a colostomy bag in addition to the catheter.

Bladder infections??

Future colostomy???

Medical malpractice????

I am so sorry that your daughter is going through this!

First of all, document EVERYTHING. You keep a journal, and get a journal for her to keep of her experiences. If she has a husband, he should keep a journal as well.

Tomorrow, Monday, call / consult with medical malpractice attorneys.

DO NOT WAIT.

It sounds like she may have some long term consequences medically, and she should at the very least have her medical expenses covered.

You know from your background that you can have an attorney review those medical records and that they employ nurses in their firms for this. Or, you could just have a disinterested (in the outcome) nurse review them. Probably easier to just turn it over to the office.

A friend whose wife is a nurse says the cut bladder could be malpractice.. and imho the bowel cut is even worse.

Sorry about your daughter, .....please do this quickly, get all records, surgical notes, most important.....labs....any tests they have done prior and afterwards...make sure to get copies of anything she has done on a daily basis.....start a file..... Dr notes, labs, and surgical notes can disappear fast and from the sounds of it they could......if dr quit the next day , it might imply he knew of his mistakes or the nurses may of went to the board.....for whatever reason sounds like he didn't do his job and now your daughter will suffer greatly.....

I agree w/ the poster who said to document everything. I had a surgery several years ago where I ended up in a coma for 15 days. When I ordered my medical records several months later, they had redacted EVERYTHING related to the coma! I wasn't planning to sue but would have been SOL had that been my intention.

I have been through two experiences that could have been pursued as medical malpractice - one during the birth of my daughter, one with my father after surgery. I did not pursue legal remedy in either case (even though my daughter died and I have lasting effects, and my father was permanently disabled due to doctor error). I took the "high road", so to speak because I am not a litigious person. In retrospect, that was stupid.

However, in you daughter's case, it sounds like there will be permanent and ongoing medical issues as a result. And, it sure as heck sounds like the doc has some culpability. How the hell do you cut the bowel during a hysterectomy and not realize it?!.

Please make sure she is taken care of in the future, as she will have medical needs she did not have before.

Get a good attorney on board ASAP. If you have no case, they will tell you. But, I'd bet your daughter does based on what you said.

Funny how the medical records have a way of disappearing when there is medical incompetence, isn't it? Happened to me as well. Hopefully, if OP gets an attorney quickly, they can begin getting copies of all of those records now before they get disappeared.

Please do not wait for attorney to get records....your daughter has a legal right to all records.....she may have to pay for them, only couple dollars.....but they will be gone faster than your attorney will get them....have her go to records, make sure to ask for the surgical notes, recovery notes, labs, nurses notes, anything that shows her health before and after....the hospital will LOOSE them, trust me.....they will end up misplaced or lost....

What were the potential complications that were explained to her prior to her signing the consent form? If they failed to inform the patient of the risks, they are liable. Hospital will be forced to show in their documentation that all possible precautions were taken and interventions provided and that patient was properly informed going into procedure of all the risks. Failure on the part of any of the health care team members to follow best practices or any proof of negligence makes them liable for malpractice. Failure to get a consent form for any of these procedures represents battery. Your lawyer will be looking through hospital documentation to see where if any malpractice may have occurred. Very sorry for what has happened...it is true what the earlier poster said: she may have long term medical problems and costs coming out of this and she should be compensated so that she can get the support and follow-up care that she'll need.

Your daughter could have had a ton of adhesions due to her endometriosis that could have plastered her colon and bladder walls to her uterus.

Damage to the bladder and ureters is a known complication of hysterectomies; damage to the colon, less so, but a risk.

Sounds like you had a pretty average gynecologist operate on your daughter, which isn't surprising because most OB-GYNs are average to terrible surgeons.

This is going to be hard case to prove malpractice on. Sorry this had to happen.

Your daughter could have had a ton of adhesions due to her endometriosis that could have plastered her colon and bladder walls to her uterus.

Damage to the bladder and ureters is a known complication of hysterectomies; damage to the colon, less so, but a risk.

Sounds like you had a pretty average gynecologist operate on your daughter, which isn't surprising because most OB-GYNs are average to terrible surgeons.

This is going to be hard case to prove malpractice on. Sorry this had to happen.

As I said previously a well respected nurse said she believed the damage to the bladder was malpractice.

Have done research on this and found damage to colon most definitely malpractice.

And to cut it and have it go unnoticed for FOUR DAYS ??

I just want to add this for the ones saying to get the records. Make SURE you get ALL of them. You can tell them all and they may still try to keep out certain parts like the nurses notes etc. Because its not "standard procedure". Just be careful of this. I've had them do it to me and had I not known better from working in medicine would have been merrily on my way oblivious to it. What they gave me on request was not even half the paperwork involved and then they wanted to charge me for the rest. I threatened to call a lawyer in front of them and they changed there tune real quick. Get a lawyer, collect the paperwork as quickly as you can because stuff will disappear, and on papers that do not require multiple signatures it WILL be edited and rewrote to cover there behinds. You can bet on it.

A bad outcome doesn't always equal medical malpractice.

Your daughter could have had a ton of adhesions due to her endometriosis that could have plastered her colon and bladder walls to her uterus.

Damage to the bladder and ureters is a known complication of hysterectomies; damage to the colon, less so, but a risk.

Sounds like you had a pretty average gynecologist operate on your daughter, which isn't surprising because most OB-GYNs are average to terrible surgeons.

This is going to be hard case to prove malpractice on. Sorry this had to happen.

any surgery's A RISK and complications such as perferations etc are a direct result of SLOPPY surgery--a colostomy ??? so she also has peritonitis etc

Sorry about your daughter, .....please do this quickly, get all records, surgical notes, most important.....labs....any tests they have done prior and afterwards...make sure to get copies of anything she has done on a daily basis.....start a file..... Dr notes, labs, and surgical notes can disappear fast and from the sounds of it they could......if dr quit the next day , it might imply he knew of his mistakes or the nurses may of went to the board.....for whatever reason sounds like he didn't do his job and now your daughter will suffer greatly.....

Yes what your referring to is a power of attorney. It will be necessary for anyone other than the patient to get access to those medical records.

I would save going to law enforcement until after I contacted an attorney. You will have to file paperwork and to get them to track this guy is going to take a little bit of pressure from what I've seen. You need to be quick about it because I've seen these SOB's up and disappear or go back to there home country and become pretty much untouchable at that point.
