Police Officer Shot and Killed During No-Knock Raid!
Maybe the 4th amendment violating will stop? Not celebrating the loss of a life, but maybe these incidents will help get laws repealed that allow no know warrants.

less than 50

Authorities went to a four-plex apartment on the 1100 block of Circle M Dr. to serve a search warrant. When Dinwiddie and another officer tried to enter the apartment, 50 year-old Marvin Louis Guy and a 49 year-old woman opened fire on authorities, hitting Dinwiddie in the face and Officer Odis Denton in the leg.

Now, because the state claims the authority to tell people what they can and cannot put in their bodies, a man is dead, and another faces three attempted capital murder charges.

Marvin Louis Guy is being held in the Killeen City Jail on a three million dollar bond, one million for each count against him.

The raid happened at 5:30 in the morning and, from what we can tell on the official report, no notification was given prior to police trying to enter the residence.

NLAWFUL ARREST

"State Police Power extends only to immediate threats to public safety, health, welfare, etc.," Michigan v. Duke 266 US, 476 Led. At 449:

“Courts are not bound by an officers interpretation of the law under which he presumes to act." Hoffsomer v. Hayes, 92 Okla 32, 227 F. 417

"An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery."
(State v. Robinson, 145 ME. 77, 72 ATL. 260).

"Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense."
(State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).

"One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance."
(Adams v. State, 121 Ga. 16, 48 S.E. 910).
.
"These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence."
Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903.

“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.

“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

“It is not the duty of the police to protect you. Their job is to protect the Corporation and arrest code breakers.” Sapp v. Tallahasee, 348 So. 2nd. 363, Reiff v. City of Philadelphia, 477 F.Supp. 1262, Lynch v. N.C. Dept of Justice 376 S.E. 2nd. 247

He gave good advice. You have to shoot to kill.
If you fire a warning shot, or shoot to maim, you cannot say you "feared for your life".

Always shoot to kill. Always kill what you shoot.

20 years ago when I took my CCW class and our county had a real Sheriff the deputy said shoot to kill, no warning shots and if you dropped someone outside of your house drag them inside.

Now we have a NWO boot licking Sheriff who is in with the Feds, and has his own SWAT style team for dynamic entries and other assorted nefarious thug activities. They now thrive on OWI and drug possession because it is easy money for them.

better to shoot to stop the deadly threat. To kill is or should be an unintended side effect.

I'm glad you brought this up. Even though all these case law are commentary on our Rights, we still have the un-a-lien-able Right to Self Defense, especially when there is a State backed proclamation that your home is your castle and can be defended from invasion (Castle laws).

However, you must be very careful about doing so in a State that doesn't think this way. You better get your own situation sorted out before you do anything else. Generally, your peers on a jury will see you as justified if your life was in immediate danger and you were in your own home, minding your own business. Then you will be seen as justified. Then again, Iv'e heard stories of parents shooting their own children as they sneak into the house late at night, so be careful who you shoot in the face. You want the right guy.

Hope the shooter gets acquitted.

Police now use No-Knock Raids FOR EVERYTHING. It has become Police State Tactics, versus Law Enforcement, and it just keeps getting worse every year.

The Police are no longer YOUR friend, even if you are the one being burglarized or attacked. You should never trust them about anything anymore.

Between the NSA, the FBI, Warrantless everything, Tracking of EVERYBODY ALL THE TIME, AND these new types of police behavior, the US HAS become a Police State without the public realizing it.

Stalin and Hitler would have been THRILLED to have the kind of spying on their own citizens that the US now DOES DAILY.
