the time to decide how you are going to go from point A to POINT B , should be reasoned out prior to your alcohol consumption, DWI,s are a very serious charge , my brother whom i loved very very much was killed by a drunk driver, the driver who killed him was killed also , BUT , had he lived i would have taken him out , no if,s ands or but,s. i have no mercy when i see a drunk driver i always call 911.

I have lost 2 family members to drunk drivers.

20 years ago, my Aunt Theresa and her friend were being dropped off at her friends house after a church bingo, in the area of Russellton, Pennsylvania. A Drunk 19 year old boy, driving a van, came around the curve at a high rate of speed, hitting my aunt and the other lady. My aunt was killed instantly, and the other lady had a crushed pelvis and broken legs, but did survive.The driver got 7 years in jail.

30 years ago, my cousin Cheryl was killed by a drunk driver here in Hammond, Indiana. The guy was going 90+ miles an hour,being chased by the cops, when he ran the red light, and hit her car on the drivers side. The impact pushed her car 150ft into a light pole. It was a closed casket funeral. The impact tore off her face and her left leg.The drunk driver got 2 years in jail.
Her disabled husband, who was blown up by a landmine in Vietnam, raised the kids by himself.Cheryl was the Maid Of Honor at my wedding.

When I was 8 months pregnant with my oldest daughter, a drunk 18 year old boy ran a stop sign, and broadsided me, totaling my car, and breaking my back in 2 places. He got a slap on the wrist, just a $500 fine, even though he had a long list of prior violations.
1 year after he hit me, he was driving on a major road, drunk again,and hit a Toyota head on. The 2 teenage girls in the Toyota lived, but are crippled for life. The repeat drunk driver died in that accident.

I do not know if I could kill a drunk driver who killed my family. As for the man who allegedly killed that drunk driver who killed his kids, I would say they should let him off. I think that anyone who just saw their kids killed by a drunk driver is not thinking clearly, to say the least.
The FIRST time that someone is drunk, and causes an accident, they need to be locked up for a very long time. If the accident caused death or serious injury, then the drunk driver should be locked up for life.

Being behind the wheel drunk and causing an accident were someone dies is no different than shooting a gun and killing someone. The person if proven guilty in court should be eligible for the death penalty, murder is murder, while one may not be mentally accountable while drunk, they knew what they were doing when they started drinking.

The problem is that it's socially acceptable excuse to get drunk, kill someone with little or no consequences. As long as you spend enough money on the most expensive attorney, you can commit murder with no risk of your own life.

If the consequences of killing someone while intoxicated included the possibility of a death penalty, you would think twice before getting drunk and driving.

No one should have ever seen what this man saw. He was wrong, but who even in their right man can fault him? His whole history of continuance just died in front of him, who could judge him?

I have tears for him at best. The law is good, having two sons is blessed. Now he has nothing, what more can they take from him?

I also would set this guy free without a second thought.

He murdered his children, the same as if he pulled a gun and shot them in the head.

I would say that justice was served, but he would have to kill the drunk driver twice for that to be the case.

David Barajas (pictured), 31, has been charged with the murder of Jose Banda, 20, a drunk driver who plowed into his two sons as pushed a vehicle on a rural Texas road, reports the Daily Mail.

After their truck ran out of gas about 30 miles from their Houston home, David Jr., 12, and Caleb, 11, were helping their father push it and were about 50-yards away when Banda crashed into them from behind.

David Jr. died at the scene from his injuries; Caleb was air-lifted to a hospital where he later succumbed to his injuries. Banda was found at the scene with a gunshot wound to the head. The police ruled it a homicide.

It is alleged at the father walked 50 yards back to his house, retrieved a gun and returned to kill the drunk driver. Personally I hold the firm belief that any convicted drunk driver who kills anyone should face the death penalty.

Not sure I this situation as it seems unusual that the father left the scene of the accident to retrieve his gun especially since his wife and daughter were also in the vehicle during the accident. Only witness was that he was seen walking up to the drunk driver's vehicle, no one saw him shoot nor according to reports, the man didn't even own a gun but ammunition similar to that which killed the man (with a single shot to the head) was found in the man's home. Seems to me there is room to assume someone else decided to dispense justice. Rather unusual situation.....


It's gone on too long that bring drunk is an acceptable excuse to murder.

A drunk person kills your children, and you had the means to do so, would you take justice in your own hands?

My attitude towards drunk driver is now worse than it was before. One of my friend's son died this week after being in a coma for more than a year after a drunk driver hurt him and two others in drunk driver accident. One lady in the car was DOA at the scene and he was convicted of one manslaughter charge and two assault charges. People are up in arms as it now just found the PA made a plea deal that even if my friends son died from his injuries, they would not seek additional charges so for a charge of assault, he murdered someone.

The underage drunk was sentenced to 7 years however will be eligible for parole in December this year as he served a year in jail awaiting trial because the judge set a half million dollar cash only bail. The drunk driver is seeking parole so he can return to his college studies and return to the parties.

I wish I could have 20 minutes alone with this drunk, after seeing the pain he caused for this boys parents, it is heart breaking. Drunk driver murder more people in month than all firearm related deaths in a year yet we do nothing to ban drunk driving.

I know I have learned by the passing of years to never say I would "such and such" in certain given set of circumstances.

Personally, had this been my children dead and I had no doubt that this drunk had killed them, in anger and lost I could see myself taking matters in my own hand just because I know without doubt that drunk driving in the United States is a free pass to kill someone.

The amount of money one has, who has been accused of drunk driving is the indicator of the amount of "justice" that they will receive as with enough money, you will not be held accountable for your crime.
