He should be getting charged for attempted murder not assault and battery.

I'm usually defending the cops on here, because a lot of you are just stupid, but this one is pretty bad.
 Quoting: Anonymous Coward 57470216
Good.....
Not much you can defend on this.
 Quoting: Anonymous Coward 57470216
Keep going......
When people get pulled over, they are usually nervous, whether they are guilty of anything or not.
 Quoting: Anonymous Coward 57470216
good....and?
You have to give the driver some leeway of irrational behavior. He just plain capped him the minute he reached into his car.
 Quoting: Anonymous Coward 57470216
yes...listening, making good points
The bad thing about this? The black ghetto culture has brought all this down on themselves and this innocent guy gets shot because of it.
 Quoting: Anonymous Coward 57470216
OH NO! You just apologized for the cop saying black ghetto culture brought this ALL down on themselves. No, sorry, it was a scared cop who brought this down on himself.
I'm sure there is a 50% chance that when someone dives into their car like that, he could be reaching for a gun. It's a sad situation.
 Quoting: Anonymous Coward 57470216
umm.....no. As apologists like you always say whenever a cop shoots someone that cops stop literally thousands of people every day and don't shoot them. The reason they don't shoot them is that thousands of times per day the person is not 'reaching for a gun'. The odds of him reaching for a gun is probably in the range of 0.001% with the rest of the time they are reaching for their wallet, insurance papers, wii controller or cane.

The perp failed to comply correctly with the officer's request. At the end of the day, the only important thing is that the officer returns home safely to his family when his shift ends.

...

As soon as I stop after seeing flashing lights, I pull out my license, and retrieve my registration and insurance from the oddly-named glove box. When the cop approaches my window, I have it in hand. Makes sense.
 Quoting: Hardwired

Sometimes even THIS behavior is deemed suspicious - like you expected to be pulled over.
 Quoting: Anonymous Coward 63202523

no it's not. it shows the cop that you are no threat dimwit.
 Quoting: Anonymous Coward 59559032

Say what you will, but I've read this in police manuals. It's about the person appearing "too prepared", and possibly wanting to avoid any possible reason for a search.
 Quoting: Anonymous Coward 63202523

putting ones' hands on the steering wheel is 100% for the cop's benefit. if they are saying this is suspicious... then we are all doomed.

The Bottom line is you cant defend the Officer for this but I say the Driver was a Dick and as for the police officer if he's that nervous he shouldn't be in this kind of business

oh by the way if that guy did reach for the gun

As alert and hyper the officer was -he would be dead

Usually people pull their license out of their wallet, they don't turn from the cop and go digging for it in their car seat.

I can understand how a cop in high alert mode could think he was going in his car to grab a gun.

Is the cop at fault in this scenario? Yeah, he was quick to judge but I feel the cop's action is within reason.

This!

A great many cops are the cowards and bullies in school....they many wear a uniform now but they are still pussies...if there is a chance that they would break a nail during an arrest, they are emptying their gun into you...

The peace officers I knew in my youth was a different breed....I remember a few that walked a beat and got into scuffles with neighborhood drunks...they wouldn't arrest the drunks because they knew the drunk's family rely on him going to work...nowaday those drunks would be full of bullets in the same encounters....

Guess what?...the neighborhood also like and respected those beat cops....can't say the same today...

The cop is an idiot. Did he really assume that the guy had his ID on him? That he wouldn't need to get it from his car? I would have done the same, to get my ID out of the car. He should have first asked, "where is your ID", that way the guy could tell him. Not only that but the guy had his hands up after the first shots, and he did not have a weapon, so why did he keep shooting?
 Quoting: Anonymous Coward 63252469

hesright

How many cops are really like this out there? The cop acted like it was a little itty bitty gun shot and will not hurt.

Horrible. Maybe some cops should lay off the uppers, i.e. red bull, caffeine and probably other similar stuff. I've seen what they consume.

I learned not to move without telling them what you are going to do, they are so paranoid it's unreal. The training of these idiots is seriously lacking...

I could tell what the man was going to do, he reached for his wallet in his back pocket and it wasn't there, so of course he's reaching into the vehicle for it so he can comply.

The cop in this case was just clueless, seeing ONLY a black man going for a gun.

"High alert mode" for a seatbelt violation eh ?

Risk murder over a seatbelt ticket , sounds logical
 Quoting: Anonymous Coward 31543670

You would be surprised by the number of people who are arrested because of a minor traffic offense. Imagine 2 cars driving down the road. One car is 20 miles over the speed limit and the other has a headlamp out. Which car should the officer stop?

Now imagine that you are the person driving 20 miles over the limit while the driver of the car with a broken headlamp just robbed a store some time ago and there are warrants out for his arrest. Which car do you want to be stopped now?

In my 20+ years as a cop, I very rarely knew that I was stopping a bad guy. The vast majority of the people who I arrested, went to jail based on dealing with the occupants of the vehicle and investigating.
