Should toy guns be banned to protect innocent children from police brutality?

To classify a BB gun as the same as a deadly weapon is being deliberately obtuse.

These guns have been played with by children for decades, thus they are toys.

The problem isn't the gun, the orange tip (or lack thereof) or the fact that it shot BB's.

Guns aren't illegal to carry. If he'd pointed it at them or threatened them, then they have a case for self defense, but he didn't. That makes it second degree murder, the intentional taking of a human life WITHOUT JUSTIFICATION and not in self defense.
