I was amazed to find that no threads were on GLP today discussing this landmark case against internet freedom and freedom of the press. We are truly doomed. I only heard of this case a few weeks ago and assumed it would be a hot-potato issue here among the freedom-mongers on GLP. I was sadly disappointed that nobody even posted anything regarding this decision. God help us.

I'm flabbergasted by the SILENCE here on GLP about this case. The HB Gary and STRATFOR hacks were huge news here when it happened. The reason we are DOOMED is that no one will stand up for FREEDOM when the shit really hits the fan. I wish it weren't true, but I I think this proves it. EFF Statement on Barrett Brown Sentencing

U.S. District Judge Sam A. Lindsay sentenced Barrett Brown this morning to 63 months in federal prison, minus the 31 months he has already served to date. He was also ordered to pay $890,000 in restitution. EFF is disappointed to see that Brown wasn’t released today, after having spent nearly three years in prison on charges stemming from his work as an independent journalist.

Brown’s work has appeared in major outlets like Vanity Fair, the Huffington Post and the Guardian. He also founded Project PM, a project to crowdsource review of documents for investigative journalism. Brown's legal trouble began in 2011, when hackers obtained a voluminous set of emails from government contractor HBGary and placed them on the Internet. He turned to crowdsourcing to review records and emails taken from another government contractor, Stratfor, after hackers broke into their servers later in 2011. Those records included millions of emails discussing opportunities for rendition and assassination, and detailing attempts to subvert journalists, political groups and even foreign leaders. They also included tens of thousands of credit card numbers and their verification codes.

This 'Hacktivist' shit and 'net neutrality' stuff isn't really my cup of tea, but I was astonished to find utter silence here on this sentencing decision. I'm of a non-partisan libertarian anarchist bent, so I'm alarmed by the loss of our freedoms. This case seems to me to be a MAJOR RED ALERT regarding the 1st Amendment....or what's left of it.

Just by happenstance (and pure boredom) last night I relived the Great Honshu Earthquake thread as it happened on GLP. Wow, what a crazy day that was! Unfortunately, 95% of the YT vids posted have been erased, censored, deleted or the user accounts rescinded. DON'T make the mistake of thinking that the internet is some permanent record of anything REAL, only those things which are there to indict YOU later.

If this Barrett Brown decision stands, I really don't see any website like Godlike Productions being around for too much longer. Unless it submits to Chinese-style censorship restrictions, it will surely disappear into the 'memory-hole' forever.

Unfortunately he was facing 105 years in prison (!!!), so he copped a plea.

But you're correct, a truly informed jury could have exculpated him under the 1st Amendment RIGHTS of a FREE PRESS.

This is an injustice of the highest order against the Bill Of Rights.

When they force you to cop a plea, you have no appeal or recourse to the Supreme Court. Sadly, it happens every day in our former Republic.

An interesting and thought-provoking chunk from Barrett Brown's lengthy statement to the court upon his sentencing....

I’m going to say a few more words about my regrets in a moment, but now I’m going to get to the unusual part of the allocution. I’m going to make some criticisms of the manner in which the government has pursued this case. Normally this sort of thing is left to one’s lawyers rather than the defendant, because to do otherwise runs the risk of making the defendant seem combative rather than contrite. But I think Your Honor can walk and chew bubble gum at the same time. I think Your Honor understands that one can regret the unjust things one has done, while also being concerned about the unjust things that have been done to him. And based on certain statements that Your Honor has made, as well as one particular ruling, I have cause to believe that Your Honor will understand and perhaps even sympathize with the unusual responsibility I have which makes it necessary that I point out some things very briefly.

I do so with respect to Your Honor. I also do it for selfish reasons, because I want to make absolutely certain that Your Honor is made aware that the picture the government has presented to you is a false one. But it is also my duty to make this clear as this case does not just affect me. Even aside from the several First Amendment issues that have already been widely discussed as a result of this case, there is also the matter of the dozens of people around the world who have contributed to my distributed think tank, Project PM, by writing for our public website, echelon2.org. Incredibly, the government has declared these contributors – some of them journalists – to be criminals, and participants in a criminal conspiracy. As such, the government sought from this court a subpoena by which to obtain the identities of all of our contributors. Your Honor denied that motion and I am very grateful to Your Honor for having done so. Unfortunately the government thereafter went around Your Honor and sought to obtain these records by other means. So now the dozens of people who have given their time and expertise to what has been hailed by journalists and advocacy groups as a crucial journalistic enterprise are now at risk of being indicted under the same sort of spurious charges that I was facing not long ago, when the government exposed me to decades of prison time for copying and pasting a link to a publicly available file that other journalists were also linking to without being prosecuted. The fact that the government has still asked you to punish me for that link is proof, if any more were needed, that those of us who advocate against secrecy are to be pursued without regard for the rule of law, or even common decency.
