The Supreme court ruled that if it's in thetrash it's part of the public domain. This ruling was on account of the FBI going through the trash looking for and finding documents proving their case in the accused's trash. However if a company has posted no trespassing signs on their property then you are trespassing. Taking stuff out of the dumpster isn't stealing but they can put locks on them legally too.

A Dayton police officer was assigned to watch Frito Lay, 49 Kelly Ave., specifically the dumpster where they put expired product, as it’s a popular place for theft, according to a police report.

Around 1:30 a.m. Wednesday, the officer observed Offinger inside the fenced area by the dumpster; saw him jump the fence and flee on foot. The officer tried to stop him, but he was later picked up.

Thats hillarious!

I remember doing that at a kid in the early 70's.

A bunch of us neighbourhood kids would ride our bikes about a mile or so to a small industrial park and raid the Frito Lay chip and hostess dumpsters. The stuff was only a day or two past the expiry date and still in the packages and boxes.

Suprised that none of us got fat from doing that!

Thanks for reminding me of a good childhood memory!

I had a friend who worked at free to lay back in the day and would give me a lot of said product, it was great! Too HELL with them now, police should be first responders and pursue REAL crimes. Otherwise, leave his common humans alone,

Frito lay is concerned with legal liability. This is the reason why they don't give away expired chips to, say, homeless shelters. The chips are perfectly fine to eat, but their lawyers tell them it makes them liable if someone gets sick from the chips, chokes, dies, etc. My employer, a very large accounting firm, used to send uneaten catered food to homeless shelters, but stopped around 2008 for the same reason, legal liability. A lot of perfectly good food gets thrown away,I take some of it home myself.

During this time they would throw old chips away, but later found that people would take them out so they instructed their employees to open every bag of chips when they deliver them to the dumpster. Frito Lay did this so it would not affect sales. They have never donated to any type of food bank because it cuts their sales. Frito Lay, which was part of Pepsico, is not a altruistic type company. They do not ever give away anything, not even their stale garbage, and it is has nothing to do with any type of liability. This liability is eliminated when it is donated to any type of food bank. Frito Lay does everything possible to ensure people buy their chips and you don't get them any other way.

Exactly on point. I worked as a temp for one of the several Frito Lay plants in the DFW area back around 2000. My assignment was counting whole chips weight vs broken chip weight after being shipped all around the state in a test of a new packaging/shipping system they were testing. I was throwing literally hundreds of pounds of chips into trash bags every day. I asked if I could take a baggie of chips home once and was quickly told "only way you can have chips is if you pay for them, the company gives NOTHING away.

On a similar note... Home Depot is pretty much the same way. Old/slightly damaged merchandise is NEVER "given" away. When I worked freight team, we'd throw away thousands of dollars worth of merchandise away. One night we were throwing away about 50 perfectly good orange 5 gallon buckets, I asked if I could have a couple, was told I could pay full price for them if I wanted them, if I tried digging them out of the trash I'd lose my job.

F*ck Homo Depot... place is fostering with liberal LGBTQ sickos anyways. I quit that job in under 6 months.
They made us endure video after video of PRO-LGBTQ propaganda for "tolerance training" during "pride month", yet I got a write up for playing "Cake and Sodomy" on my phone while working by myself during my overnight shift. F*ucking hypocrites.....
