The company changed hands and they simply told him to go home as he was no longer needed. Straight to a lawyer and eventually received a proper payment. It sounds like the company you worked for simply want you to go away. Suggest talking to a lawyer and I am not an expert but I think they owe you a proper payout. Talk to a lawyer quickly. They are gambling that you will do/say nothing. |

I know that I am entitled to two weeks pay but I can not get any money from my employer while I am collecting workers comp. They didnt clear the ice. Its against the law to fire you from an injury thats their fault. Any injury really. Thats discrimination. Sounfs like they replaced you with someone with a lower wage. Better call saul. They allowed you to walk on that ice. Sounds like attempted murder to me. Sue them for wages you would of earned till the day you would normally retire. Pain and suffering they are obliged to pay for too. Any medical expenses you made they pay. Talk to wcb about this. Do this wisely. Thats my 2 cents. Hope you get through this. |

Right now concentrate on getting well!! When one door closes another one opens!! I don't know what type of work you do but I passed on a chance to be retrained when I injured my back and had it fused, I didn't know at the time that I would keep receiving comp payments while being retrained, I could have gotten into computers and this was in the early 80's and didn't realize that I could have made more in the long run. So this might be an opening for you to do work that maybe you always wanted to. And you will likely get a permanent partial disability award when the doctors are done with you. Go to your state homepage and go to your labor and industry section and it will give you an idea that you are entitled to. Try to enjoy your time off!!!! ![]() |

Hardest thing I've every had to go through...loss of job, loss of earning capability, loss of lifestyle, loss of friends and customers from work, loss of health, and the loss of most of my faith in humanity. Best advise that I can give someone in your situation, is not to let anger, bitterness, oppression, and weariness, sink their roots too far into your spirit. This was my biggest battle, taking care of my wounded spirit and allowing it to be restored to some semblance of "normal", and not letting it atrophy into someone that would not resemble the whole person I was before my accident. I'm sorry for your loss, and wish you the best durning this difficult time. This is where you'll really find what your foundation is made out of. Thankfully, my foundation was strong enough to watch most of what meant anything to me in life, crumble to the ground in little pieces. I have survived by being thankful for having a foundation that allowed me to find hope, peace, and enough testicular fortitude to want to pick up the pieces of a broken life and find a new normal. You have a discrimination / retaliation claim related to your injury, you have a potential age discrimination claim and let them think up the rest. I went through something like this, signs an agreement to not file any lawsuits and got a comfortable settlement check that paid my living expenses for several years. |
