My advice, get a free consultation from a few different law firms. They may tell you that you have a good case to file a lawsuit. 25 years is a long time.

A fella I know worked for 23 years at a company. The company changed hands and they simply told him to go home as he was no longer needed. Straight to a lawyer and eventually received a proper payment. It sounds like the company you worked for simply want you to go away. Suggest talking to a lawyer and I am not an expert but I think they owe you a proper payout. Talk to a lawyer quickly. They are gambling that you will do/say nothing.

Where I live you can be turfed without reason but you must be given compensation. I know that I am entitled to two weeks pay but I can not get any money from my employer while I am collecting workers comp. I get 85% of my salary but it is tax free money so I am actually going to get more take home pay for the 6 months max.

Its against the law to fire you from an injury thats their fault. Any injury really. Thats discrimination. Sounfs like they replaced you with someone with a lower wage.

Yeah? Well here is there defense. I came to work too fucking early. Maintenance had not arrived to lay down the salt and sand. Yes I arrived early. I love my job and always arrived early.Also it gives me time to check this site out, read news, and have a coffee before I start.

On the upside I have some good meds and a bottle of dark rum to make me a highball.

A court would whip that firm into next week, in my country. You should claim compensation for your accident at the workplace. Cut and dried, no brainer. You sign anything relating to severance pay and they are off the hook.

Sometimes with a injury you might qualify for retraining and you would still get your workers comp. payment while you're being retrained. Right now concentrate on getting well!! When one door closes another one opens!! I don't know what type of work you do but I passed on a chance to be retrained when I injured my back and had it fused, I didn't know at the time that I would keep receiving comp payments while being retrained, I could have gotten into computers and this was in the early 80's and didn't realize that I could have made more in the long run. So this might be an opening for you to do work that maybe you always wanted to. And you will likely get a permanent partial disability award when the doctors are done with you. Go to your state homepage and go to your labor and industry section and it will give you an idea that you are entitled to. Try to enjoy your time off!!!!

I'm sorry that this happened to you OP. It truly is insult to injury, and a great loss across the board with every facet of life. The same thing happened to me...injured on the job in a car accident...loss of job after 29 years of service. Hardest thing I've every had to go through...loss of job, loss of earning capability, loss of lifestyle, loss of friends and customers from work, loss of health, and the loss of most of my faith in humanity. Best advise that I can give someone in your situation, is not to let anger, bitterness, oppression, and weariness, sink their roots too far into your spirit. This was my biggest battle, taking care of my wounded spirit and allowing it to be restored to some semblance of "normal", and not letting it atrophy into someone that would not resemble the whole person I was before my accident. I'm sorry for your loss, and wish you the best durning this difficult time. This is where you'll really find what your foundation is made out of. Thankfully, my foundation was strong enough to watch most of what meant anything to me in life, crumble to the ground in little pieces. I have survived by being thankful for having a foundation that allowed me to find hope, peace, and enough testicular fortitude to want to pick up the pieces of a broken life and find a new normal.

As a guy who's been a work comp claims adjuster I'm telling you it's time to lawyer up.

You have a discrimination / retaliation claim related to your injury, you have a potential age discrimination claim and let them think up the rest.

I went through something like this, signs an agreement to not file any lawsuits and got a comfortable settlement check that paid my living expenses for several years.
