In a few cases, the efforts to protect sacred sites during the 1970s and 1980s were successful. In 1970, President Nixon signed legislation returning part of the sacred Blue Lake in New Mexico, which had been annexed by the United States in 1906 of the Taos Pueblo. Another example of a successful defense of a sacred site involved Kootenai Fall in Montana which was threatened by proposed hydroelectric development in the 1980s. An administrative law judge ruled that the project was against the public interest.

However, throughout those years, most of the disputes between traditional Indian religious practitioners and federal and state governments were resolved in favor of the government - with a resulting impact upon the ability of practitioner to utilize these sacred sites. For example, cases were decided which permitted the following activities to take place: * Development of a ski area on the San Francisco Peaks in Arizona, sacred to the Hopi and Navajos * Construction of viewing platforms, parking lots, trails and roads at Bear Butte in South Dakota, sacred to many Plains Indians * Flooding of sacred Cherokee sites by the Tennessee Valley Authority

In 1988, the United States Supreme Court directly considered the issue of the First Amendment protection of sacred sites in the case of Lyng v. Northwest Indian Cemetery Prot. Assn. The case involved the construction of a road by the Forest Service in Northern California which the government asserted would improve access to timber and recreational resources. The federal trial and appellate courts had ruled in favor of the Indian religious practitioners, applying a balancing test known as the "compelling interest" test; the courts had held that the negative impact upon the traditional Native American religious practices outweighed the government's interest in building the road.

Many of these artifacts are 10,000 years old and have absolutely no connection to the Paiute. The Feds are only hiding behind the Paiute and the Paiute seem to forget that it was the Feds that kicked them off and screwed them out of their land. If it were up to the Feds and their Indian policy, the Paiute would have been entirely exterminated over 100 years ago.

According to a book written in 1882 by Sarah Winnemucca Hopkins, Life among the Piutes [sic]: Their Wrongs and Claims, her people rose up against a small tribe of barbarians who would attack her people and eat them, hundreds of years ago . . . She wrote that they were said to have reddish hair, and said she owned a dress trimmed with their red hair that had been passed down through the generations.

You are exactly right. I wonder why some of the tribes have been able to survive and thrive, while others have been destroyed by the Feds?

Here in my area, we have the Eastern Band of the Cherokee, and the town of Cherokee is beautifully thriving.

Those horse herds? Are remnants of ranchers' horse bands that they let run wild, they would capture and break the foals, leaving the mares and a stallion to roam the range and breed. Their unchecked populations have become a huge problem for western rangelands as horses paw to dig up the roots of bunch grasses doing irrepairable damage to the land. It was not until Wild Horse Annie and the Wild Horse and Burro Protection Act that the horses became such a problem. Thank YOU city folk for imposing impractical regulation upon land and ecosystems you know nothing about.
