Judge Upholds Suspension Of 2nd Grader Who Chewed Pastry Into Shape Of Gun

The suspension of second grader who chewed his breakfast pastry into the shape of a gun was upheld by a circuit court judge last week.

Joshua Welch was suspended from Anne Arundel County’s Park Elementary in March 2013 after chewing his pastry into the shape of a gun and “[pretending] to fire it.” The student’s father, B.J. Welch, took the matter to court in hopes of having the suspension reversed and expunged from his son’s record.

But WJZ 13 reports that an Anne Arundel County circuit judge upheld the suspension, ruling that Joshua’s actions were “disruptive.”

Anne Arundel County Schools reacted to the ruling by releasing a statement which said, “We have believed from the outset that the actions of the school staff were not only appropriate and consistent, but in the best interests of all students.”

Welch family attorney Robin Ficker lamented the ruling and pointed out there was “no violence, no real weapon, no ammunition.” But the suspension will now “be on [Joshua’s] record in school… every time he goes into a new grade.” by AWR Hawkins

Zero tolerance is bullshit.

"Disruptive" is not enough of an excuse to suspend a student.

If it were, 50% of every class would be suspended.

Little Bobby making jokes in the back of the room is disruptive.

Retard Jimmy making moaning noises and drooling all over his desk is disruptive.

Tiny Tina wearing here mini-shorts with cheeks hanging out the bottom is disruptive.

The Main Office paging into the class for BS reasons is disruptive.

I ask this in all seriousness...are kids allowed to have fun anymore? I absolutely get what you're saying about disruptions in the classroom versus the lunch room or playground. Kids have to sit in a desk damn near all the time. Sit down, shut up and do the work we tell you to do. It would make sense for the kids to be a bit rowdy and worked up during the few times they get "free time".

It's a fucking pop tart gun that couldn't hurt anybody or anything. It's not like the kid's out there setting fire to the school or something, ya know?

And I also lead into this point of view. I'll admit right off the bat I hated school. I had things to dread about school AND I had a few pleasures about going to school. I wonder how many kids are going to be so fucked up, have anxiety issues because schools freak out about so much these days? I can't do that because the establishment might label me a junior criminal or terrorist--even if it's something normal that kids used to do. I'm a girl so I was more into playing with dolls versus 'cops and robbers', I bet a kid couldn't play shit like that anymore even if they wanted to. Doesn't matter if we're talking at school or at home. Goodness knows I know I had a few water guns when I was a kid, I think I played with them more to keep cool than anything else.

It just seems like we're at a level where the adults are pretty much drained dry and they're working on the kids. I guess if you've lost all your life energy, you're better being a slave to whatever this goddamn existence is. Stuck on repeat.
