The Law DOES NOT APPLY TO CABLE

What are the statutes and rules regarding the broadcast of obscene, indecent, and profane programming? Title 18 of the United States Code, Section 1464, prohibits the utterance of any obscene, indecent or profane language by means of radio communication. Consistent with a subsequent statute and court case, the Commission's rules prohibit the broadcast of indecent material during the period of 6 a.m. and 10 p.m. FCC decisions also prohibit the broadcast of profane material between 6 a.m. and 10 p.m. Civil enforcement of these requirements rests with the FCC, and is an important part of the FCC's overall responsibilities. At the same time, the FCC must be mindful of the First Amendment to the United States Constitution and Section 326 of the Communications Act, which prohibit the FCC from censoring program material, or interfering with broadcasters' free speech rights.

What makes material obscene? Obscene speech is not protected by the First Amendment and broadcasters are prohibited, by statute and regulation, from airing obscene programming at any time. According to the U.S. Supreme Court, to be obscene, material must meet a three-prong test: (1) an average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest (i.e., material having a tendency to excite lustful thoughts); (2) the material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and (3) the material, taken as a whole, must lack serious literary, artistic, political, or scientific value. The Supreme Court has indicated that this test is designed to cover hard-core pornography.

What makes material indecent? Indecent material contains sexual or excretory material that does not rise to the level of obscenity. For this reason, the courts have held that indecent material is protected by the First Amendment and cannot be banned entirely. It may, however, be restricted to avoid its broadcast during times of the day when there is a reasonable risk that children may be in the audience. The FCC has determined, with the approval of the courts, that there is a reasonable risk that children will be in the audience from 6 a.m. to 10 p.m., local time. Therefore, the FCC prohibits station licensees from broadcasting indecent material during that period.

There are a couple of other threads regarding the latest airing of this show. I've never watched it, and the other threads don't mention what was actually shown other than something about how messed up it was. If even the hard-core fans of the show are upset, I guess it must have been pretty bad.

Q: Does the FCC regulate the content of cable programming?

A: Cable television system operators generally make their own selection of channels and programs to be distributed to subscribers in response to consumer demands. The Commission does, however, have rules in some areas that are applicable to programming -- called "origination cablecasting" in the rules -- that are subject to the editorial control of the cable system operator. The rules generally do not apply to the content of broadcast channels or to access channels over which the cable system operator has no editorial control.

Yes, it was horrific, but this was cable, and there were HUGE warnings in BIG LETTERS at the start of the show, and after every commercial break stating "GRAPHIC VIOLENCE".

Not true. AMC has to censor itself that's why they have the director cuts of TWD where they swear "fuck" on BlueRay.

That's an interesting piece of legal jargon. It states they do have some rules, but that they generally do not apply to the content... what do they apply to?

TWD have routinely discussed flying under the radar of what's allowed on TV on TTD... so they clearly have rules. They do not use "fuck", but they use "shit"

Is using FUCK worse than showing this kind of violence that surmounts to torture porn?

a baseball bat wrapped in bwire? You mean like when we see them carrying machetes and stakes in other episodes?
That bat in and of itself did not create the horribleness of the scenes, the writers and director and producers did.

It's some mkultra'esque programmed response. People saying nearly identical statements in the same tone. Here, and social media. There's an agenda - though I don't know what it is.

It really makes no sense that this would be the tipping point. They've point blank shot 2 little girls and Carl's been shot twice. If you're gonna cross a line - that should be the line right? Not a bludgeoning - when they do it to walkers weekly AND it's all but identical to the comic book which has been out forever, so people knew this was coming.

I think it's the same programming that triggers when they hear "trump" and "make Ameica great again."
God Bless President TRUMP! GOD BLESS AMERICA!!

It was the way it was done.

It did not maintain the expected levels of violence but exceeded them and surpassed anything shown on TV, ever. In a sense they broke the trust of the public by subjecting the viewers to a level of violence not yet established on the show. In many instances the violence was comic-book before whereas this was a snuff film re-enactment.

Not an enjoyable way to spend my Sunday evening in truth...

But I love the zombie genre; Day of the Dead, Dawn of the Dead, The Return of the Living Dead my 3 favs so I became a fan of the show.

But I think the Negan kill scene was done in bad taste, specifically the Glenn death.

I haven't watched that show in a long time, that clip in the opening post was disturbing, the way it played out with the killer taking great pleasure in bashing their brains in while the others had to watch was almost more disturbing than the graphic content. I wonder if parents are letting their kids watch this shit.

I actually cringed and closed my eyes a time or two watching that video, and I've seen almost everything.

I think its interesting how I get called a red karma tagged "pussy" and like-minded comments. Negan called the group "pussies" for crying while he was smashing in Glenn's skull.

Sure are turning into a nice bunch of people.
