Johnson's Security Pick Probed by Police

Prince George's County Executive Jack B. Johnson has chosen as his deputy director of Homeland Security a police corporal who was temporarily suspended in January after an off-duty scuffle and is facing an internal investigation, authorities said.

In an announcement posted on the county's Web site this week, Johnson named Cpl. Keith Washington, 43, to the newly created job, touting his "extensive military background," knowledge of anti-terrorism tactics and community ties.

Washington is already serving in the $73,000-a-year job in an acting capacity, county officials said.

His appointment comes the same week that Johnson named an acting fire chief, Lt. Col. Darrell Odom, 49, who has three arrests and one conviction for simple assault. Both men supported Johnson in his 2002 electoral bid; Washington sometimes served as his driver.

"There are few appointments as important as this one," Johnson said in the posting about Washington's job. "With his extensive experience and local ties, Keith Washington will lead this county in the right direction ensuring that the office of Homeland Security provides the protection and required services that the county needs and desires."

Johnson and Washington did not return calls seeking comment yesterday and Wednesday. Odom was out of town and could not be reached.

Some community activists expressed concern about the background of Johnson's latest appointees. "That's troubling to know," said Arthur Turner of Kettering. "I know sometimes people make mistakes, but in some positions, especially ones in law enforcement, I would prefer to have someone who is not blemished with violent incidents."

Others pointed to a pattern of rewards for Johnson's friends and supporters. For example, Shailender K. Gupta, a Greenbelt accountant who was Johnson's campaign treasurer, received $75,000 to study the Prince George's hospital system. Another supporter, former state delegate David Valderrama, received a $53,000 county contract to monitor the construction of public schools. Neither man had any experience in the area he was paid to study.

Vernon Herron, the county's Homeland Security director, said Washington's military and police experience will enhance the office. "Mr. Washington's record speaks for itself," he said.

Washington, a 14-year veteran of the force, served for five years in the Army and has spent 19 years in the reserve, where he has received training in homeland defense, a county spokesman said. He worked as a detective in Hyattsville before joining Johnson's security detail.

As Washington assumes the new post, an internal police probe continues into three incidents at meetings he attended as a board member of the Simmons Acres Homeowners Association in Accokeek.

On Jan. 28, he was accused of assaulting a property manager. He was charged with a misdemeanor and suspended with pay pending an investigation. The charge was dropped March 23, court records show.

Two association officers said they filed separate complaints against Washington alleging verbal and physical harassment.

Dennis Tozser, the association's treasurer, said Washington pushed him at a Jan. 7 meeting. "He actually shoved me," Tozser said. "He was trying to bait me into a fight, so he shoved me in the chest."

Kathryn Keys, the association's president, said she filed a complaint after Washington verbally assailed her Jan. 14. "He confronted me after a board meeting and started yelling, screaming and cursing at me," Keys said in an interview.

A police spokesman said yesterday that internal affairs investigators last week passed their findings to a civilian complaint oversight panel, which will conduct an independent inquiry. The results will be turned over to Police Chief Melvin C. High.

Washington has also been the subject of scrutiny for an on-duty incident. Washington and several corrections officers were accused in a civil suit of violating the rights of an Adelphi man who was arrested and strip-searched after protesting the way Washington treated a motorist.

A jury in May 2000 found for the plaintiff, David P. Maslousky, and awarded him $260,000. The case was later appealed, and at a new trial, Washington prevailed, said Maslousky's attorney, Terrell N. Roberts III.

On Monday, Johnson announced that Odom would serve as acting fire chief when Chief Ronald D. Blackwell leaves for a similar post in Anne Arundel County on Aug. 20.

Odom was found guilty in 1980 of simple assault and sentenced to 10 days in jail and a $300 fine, according to D.C. Superior Court records. The jail time and $200 of the fine were suspended. Two years later, Odom was charged with possessing a prohibited weapon and simple assault, charges that were never prosecuted, records show.

In 1992, he was charged with simple assault in an incident involving his wife at their Northwest Washington home, court records show. The case was later dismissed, and Odom tried to have the records sealed.

The parents were interviewed outside the PG Co. hospital.

It's been over 24 hours since they were shot.

The police and/or hospital won't let family members inside the hospital. They won't let anyone see the wounded men.

They said the only thing they know is that neither of them have been charged with a crime.

The hospital won't tell them anything at all. The mother of one was crying, saying they don't know if their sons are dead or alive.

This is really messed up.

Prince George’s County police say assault charges are pending against the two men shot last night by county police officer Keith Washington, after they allegedly attacked him in his own Accokeek home.

Police spokeswoman Lt. April Delabrer declined to identify Washington officially as the shooter, but sources in the police department have confirmed Washington as the officer in question. Washington is also the county’s deputy director of Homeland Security.

Police said the official shot two men who were delivering furniture after they got in an altercation on the second floor of his house at about 7:45 p.m. Wednesday. Police said the men assaulted the official, who then, ‘‘fearing for his life,” fired his county-issued 9mm Beretta, to repel the attack.

Delabrer said the men were 36 and 22 years old. Both were shot in the upper body area and are in ‘‘critical but stable” condition at Prince George’s Hospital Center, according to a police source.

Delabrer said no shots were fired at the officer, and that the officer’s gun was the only known weapon at the scene.

Washington has been placed on administrative leave with pay pending an internal investigation.

‘‘He will receive legal counsel [from the police union],” FOP 89 president Percy Alston said.

A police source said there was a scheduled furniture delivery at that time, and that the two men who allegedly assaulted Washington were bigger than him – about six feet tall, 250 pounds each.

Washington is a 16-year veteran of the force, but has faced court action in the past. In January 2004, he was charged with assaulting a resident at a homeowners association meeting. Those charges were later dropped for lack of evidence.

A suit was also brought against him in 2000 by a resident who claimed Washington abused and taunted him during an arrest. The plaintiff initially won a $260,000 judgment in that case, but the decision was later overturned.

Washington ran unsuccessfully for County Council in the September primary for a seat won by incumbent Marilynn Bland.

He is a known ally of County Executive Jack B. Johnson and once was his driver. Washington is active in several local organizations, and is a lieutenant colonel in the U.S. Army Reserve.

The hospital won't comment on the extent of injuries or give the families any information.

I just can't imagine surviving 3 shots to the chest with a 9mm.

Maybe they're actually dead and officials are keeping it quiet until Cpl. Washington can pack his bags and leave town.

Family Disputes Account in Pr. George's Case; Two Wounded Men Were Unarmed

The movers arrived at Keith Washington's home in Accokeek on Wednesday night for what was to be a simple swap: one Marlo Furniture bedroom set for another.

An argument began between Washington and the two men and escalated quickly, authorities said. It ended when Washington, who is a police officer and a top homeland security official in Prince George's County, drew a 9mm Beretta and opened fire on the unarmed movers, they said.

Police said that they believe the officer, a 16-year veteran, acted in self-defense and that the two wounded men probably will be charged with assault, based on statements from Washington and a family member whom they did not identify. A police spokeswoman, Cpl. Debbi Carlson, said the officer suffered serious injuries -- she declined to describe them -- and required treatment at a hospital.

The movers -- Robert White, 36, of the District and Brandon D. Clark, 22, of Oxon Hill -- remained in critical condition yesterday, and Carlson said police had not heard their accounts.

Clark's live-in girlfriend, Leelee Best, echoing the sentiment of his family members, questioned the police claim that the movers were the aggressors, saying police "need to charge [Washington] for shooting them."

"It's stupid, honestly," Best said of the argument. "All he had to do was just tell them to leave. There are other ways you can handle it than shooting somebody."

Washington, 45, a former driver for County Executive Jack B. Johnson (D), has long been a controversial figure. He was sued in 2000 by a man who claimed to have been arrested and strip-searched for protesting Washington's rough treatment of a motorist; a civil verdict against Washington for that incident was overturned on appeal. Washington also was later temporarily suspended for alleged aggressive behavior during meetings of a homeowners association board on which he served.

Because of that history, Johnson was accused of cronyism and poor judgment when he named Washington in 2004 to be deputy director of homeland security. Johnson brushed off the criticism, saying that he hired Washington in part because he is "mentally tough."

Washington, who was released from the hospital, did not respond to messages seeking comment, and no one answered the door at his home. An attorney who has represented him before did not respond to a phone call seeking comment.

Yesterday afternoon, Best said a Marlo delivery contractor for whom Clark worked knocked on the door of their home at close to midnight Wednesday. "I knew something was wrong," she said, speaking at Prince George's Hospital Center.

Best said the contractor told her that Clark called him from Washington's house Wednesday evening to say that Washington was angry over a bedroom set that was being exchanged.

Michael J. Winkelman, an attorney representing the families of White and Clark, said a Marlo representative and an associate he believes was the contractor visited with the family at the hospital yesterday. The associate told the family that the movers had sought guidance from a supervisor about how to handle the clash with Washington.

"They called from the house and said he was upset, very upset," Winkelman said. He said the movers were told to "give the officer what he wanted."

Marlo officials declined interview requests yesterday. The company issued a brief statement pledging to cooperate with the investigation and adding that its priority is "the welfare of those who have been injured."

In a news release, police said both deliverymen were struck in the upper body. A law enforcement source, speaking on condition of anonymity because the investigation is continuing, said that White was shot in the chest, groin and knee and that Clark was shot in the abdomen. The Washington Post erroneously reported in some editions yesterday that one man had been fatally shot, based on inaccurate information from a government source.

State's Attorney Glenn F. Ivey said two investigations of the incident will proceed on separate tracks: One team of police detectives will investigate the use of force by Washington, and a second set of detectives will look into what crimes, if any, occurred during the encounter.

Winkelman said he was not surprised to learn that police expected to charge the unarmed men shot by an officer. "It's the custom of the Prince George's County police to do so," he said.

Clark's girlfriend and father said their anxiety was compounded yesterday by the hospital's refusal to update them on Clark's condition -- or even, for most of the day, to confirm that he was a patient there. Winkelman said hospital officials told the family that "an ongoing police investigation overrides hospital authority."

Attempts to reach members of White's family were unsuccessful. Winkelman said late yesterday that he also could not immediately reach members of the family.

Clark's family described him as a gentle giant, easygoing and slow to anger. He stands 6 feet 4 inches and weighs more than 260 pounds, according to a younger brother, Nathaniel B. Saunders.

"He gets along with everybody," Saunders said. He said Clark graduated from DuVal High School, where he played on the football team.

Washington was a detective when Johnson, then the state's attorney, tapped him to become part of his security detail. He enthusiastically endorsed Johnson's 2002 bid for county executive, contributing to and working for the campaign.

Washington rose fast after Johnson's election. In 2003, Johnson named Washington to his transition team. In August 2004, he appointed Washington deputy director of homeland security.

The appointment came eight months after Washington was placed on administrative leave pending the outcome of an investigation into whether he hit a member of the Simmons Acres Homeowners Association during a meeting. The complaint was later dropped without legal or administrative action.

In 2000, a federal civil jury awarded $260,000 to the plaintiff in the civil rights suit against Washington and county correctional officers. The man, David Paul Maslousky, said he was arrested and strip-searched after he protested Washington's treatment of a man who had been involved in a minor traffic accident. The case was appealed, and Washington prevailed.

Last year, Johnson contributed to Washington's unsuccessful bid for the seat of County Council member Marilynn Bland (D-Clinton).

James Keary, Johnson's spokesman, said the county executive would not comment on the case. "It's a police matter, and it's under investigation," Keary said.
