Judge blocks Obama rule extending overtime pay
Here's to hoping (for small business owner's sake) this block holds up and this doesn't go through - at least at the amounts President Obama proposed.


"A federal judge on Tuesday blocked an Obama administration rule to extend mandatory overtime pay to more than 4 million workers from taking effect, imperiling one of the outgoing president's signature achievements for boosting wages.

U.S. District Judge Amos Mazzant in Sherman, Texas, agreed with 21 states and a coalition of business groups, including the U.S. Chamber of Commerce, that the rule is unlawful and granted their motion for a nationwide injunction. It was to take effect Dec. 1.

The rule would have doubled to $47,500 the maximum salary a worker can earn and still be eligible for mandatory overtime pay."

I love how they call it a "rule".

It was an Executive Order FFS! Another unlawful act attempted to be perpetrated upon us.

I mean the basic facts in reporting and they can't even do that. Call the shit for what it is.

That's what it is a Department of Labor Rule. I do human resources and that's what it's been referred to in all documents published by the DOL and other HR publications.

We were going to give massive pay cuts to three employees that fall into this category. With overtime, it was hoped that they would get back to their previous year's pay amount - but no guarantee.

These three people were all very vocal democrats, so I was going to give them the "change" they were asking for.

I still might carry through with those plans, since this ruling has not been publicized well in my area...

On the other side of that, some smo making $11.50 an hour can be called management and be worked like a slave with no recourse but to quit there job.

If I remember correctly that was a bush thing.

The ruling is not final - I would still proceed with your plans. Until this rule is overturned, what President Obama proposed is in effect and goes into place December 1.

You can't just call someone management and get away with not paying them overtime. There's a duties test the employee has to pass depending on their occupation. If an employee is improperly classed then the employee can sue for unpaid OT and get not only the back OT wages but interest and employer has to pay fines on top of it.
