Woman Dies After Taser Gun Deployed 10 Times, Family Files Suit

GREEN COVE SPRINGS, Fla. -- The family of a 56-year-old woman, who died shortly after officers used a Taser gun to subdue her, said it wants answers and plans to file suit, according to WJXT-TV.

Emily Delafield died in April 2006 after a confrontation with police at her home in Green Cove Springs.

The day of the incident, Delafield's family had called 911 and said the their loved one, who was in a wheelchair, had armed herself with two knives and a hammer and was threatening to kill them.


Investigators said officers tried to take her in to custody peacefully, but were unsuccessful because Delafield would not give up her weapons.

A report states that the officers consulted with the family, asking them if it was OK to use their Taser guns and the family gave the officers permission.

However, the woman's nephew, Ryan Delafield, said the officers should have never asked the family because he said they are the experts.

He said his aunt never should have been shocked with the Taser gun, especially not 10 times, WJXT-TV reported.

"When I found out that she'd been Tasered 10 times for two minutes, it's almost like, was she on death row? I don't know if I were to get Tasered 10 time for two minutes, and I think I'm a pretty healthy individual, I don't know if I'd survive that," Delafield said.

According to a police report, one of the officers used her Taser gun nine times for a total of 160 seconds and the other officer discharged his Taser gun once for a total of no more than five seconds.

A medical examiner found Delafield died from hypertensive heart disease and cited the Taser gun shock as a contributing factor. On her death certificate, the medical examiner ruled Delafield's death a homicide.

The division chief for the Clay County State Attorney's Office reported that the officers were justified in using their Taser guns on Delafield.

The report goes on to state, "the officers could have opted not to Tase Ms. Delafield with two separate Tasers. Additionally, the officers could have decided upon a different approach once they realized that their Tasers were not causing Ms. Delafield to drop her weapons."

Family members said the Taser gun use was excessive and they have hired an attorney to help search for answers.

"I want answers," Delafield said.

He said he would never forget the night he received a phone call telling him officers had used a Taser gun on his aunt and she had later died at the Orange Park Medical Center.

"We're going to follow where the evidence leads, but right on the face of it that's pretty shocking," said the family's attorney, Rick Alexander.

The family's attorney said he would be filing suit in state and federal court.

Considering the fact that Ms.Delafeld was physically unable to get out of her wheelchair, and therefore totally unable to attack the officers with any of her alleged weapons unless they walked right up to her, they could have just decided to keep their distance and talk calmly to her until she decided to give up.

But that wouldn't have been any fun at all.

look at it this way...two standing people with the ability to move...have many more options when dealing with someone sitting in a wheelchair.

a simple solution would have been...if they were out of time...too busy...they could have gotten a blanket and tossed it over her head and she wouldn't be able to see while they then grabbed her arms and de-weaponed her. simple solution...and no death.

say they stayed all night and finally got the weapons off of her, a few days later (after a visit to some mental health workers) she`s at home and decides to go ahead and
kill a family member, then what...oh ya the family is sueing the mental health because they didnt commit her.

This is a society of laws and if you cant follow them
then perhaps you should leave...are there bad cops...ooh
yeah, but that doesnt mean they somehow did their job wrong
nor does it mean you have all of the details. I find it funny how when something in the media you dont agree with

So if it was YOU in the wheelchair, and if YOU were having a really bad day (being confined to a wheelchair might have that sort of effect on people)....

How much time time would YOU have liked to have the police invest in calming you down, and de-escalating the situation, before they decided to kill you?

How many minutes, or hours, would you choose to have your public servants take out of their busy (but totally taxpayer funded work day) before they violently end the life of one of the people (you) they are supposedly being paid to protect?

The police are conditioned and trained to believe they are involved in a war against us, the people they supposedly protect.
The fact is the police do not protect us from each other, but only the rich from the poor to boil it down to brass tacks.

The police consider me the enemy, and they are right. So long as police act as if we are the enemy, I will be a formidable enemy. Use the law , and complain loudly and publically, and you can control police abuse.

a taser is generally not lethal, that is why they are allowed. I dont understand why people always stick up for
lawbreakers. It is against the law to grab knives and hammers and threaten to kill people. You do not know
how long the officers were talking to hear do you?
I dont care if someone is upset, if you are told by an
officer of the law to drop a weapon you drop it and if you
dont you face whatever it takes to get it away from you.

Police officers have an extremely shitty job, they put up
with more bs than one person should have to handle and they
do it daily. I got an idea, why dont some of you people
who think all cops are screwing the public go on some
ride alongs, it would be an eye opening experience for you.
Sometimes they go beyond the law and should be punished but
without all of the information you should`nt lump them
all together. Hell 60% of a criminal case is never in
the public realm and if it was would the papers publish it?

I don't know what it is about people who choose to be police officers, but they tend to be violent, aggresive power trippers and have very little respect for the law as it applies to them, while willing to stretch ot pervet the law to get someone they want... Speeding cops are an example we all deal with daily. police believe they have immunity from law because they enforce law.I have a state police oficer who drives past my residential nighborhood with small children every day on his way home from work , in excess of 70 miles per hour in a 40 mile per hour zone. complaints yielded notthing but threats, enough said.
