Neil Gorsuch's opinion regarding a 13 year old student-clown who repeatedly burps in class - gets arrested

Supreme Court nominee Neil Gorsuch has written 800 opinions as a US appeals court judge. Buy the burp-clown case might reveal more about Gorsuch than almost any other.

So a kid intentionally burps in class, distracting his classmates and the PE teacher.

Teech sends the burper into the hallway. The student continues to pop his head around the corner.

Instead of sending the student to the vice-principal's office, the teacher calls for a police resource officer. He arrests the teen. The boy spends an hour in juvenile detention before being released with no charges filed against him.

His mom sues and the case ends up before the Appeals Court.

Siding with the minority, Gorusch voted in favor of the mother.

"The majority took 94 pages to justify the position that the officer was reasonable in believing a 13-year-old boy violated a New Mexico statute making it a crime to “willfully interfere with the educational process of any public or private school” (N.M. Stat. Ann. § 30–20–13(D)).

"Gorsuch, however, took less than four pages in dissent to explain that a reasonable police officer should have understood that arresting a 'class clown for burping was going a step too far.'”
