You're completely wrong, of course. James Madison said: "that as they [aliens], owe, on the one hand, a temporary obedience, they are entitled, in return, to their [constitutional] protection and advantage." More recently, the U.S. Supreme Court ruled in Zadvydas v. Davis (2001) that "due process" of the 14th Amendment applies to all aliens in the United States whose presence maybe or is "unlawful, involuntary or transitory." But it was really settled long before in the late 19th century cases of Yick Wo v. Hopkins (1886) and Wong Win v. United States (1896). [ link to thehill.com] So many problems with this! No one has any Constitutional rights since rights can't be granted by a document. The Bill of Rights was meant to safeguard certain rights already acknowleged to exist. The Constitution was a document forged by the states to create a government with limited powers and responsibilities. It is charged with defending the rights of it's citizens. While the same rights were understood to exist for all people the government has no responsibility to defend and protect the rights of people who are not its responsibility. The idea that they must spend the blood and treasure of its citizens to defend the rights of illegal invaders is ridiculous in then extreme. The supreme court is not authrized to create law. Any decision they have ever rendered that granted new powers or changed the understanding of any law is outside their charter and is null and void. The people have the last word on the law of their land, not the supreme court.
