Even if you never laid a finger on her. What this does is restrict you from the marital home as well as from seeing any children you may share until the hearing. If this happens, you should file a continuance to give you time to build a case. The length of this continuance varies by jurisdiction. It is possible to get this charge dropped, but not easy. Remember lads, all it takes is an accusation.

If your wife is that whacky that she would do this to her husband and harm the kids in the process, you probably need to suspect she is doing drugs or drinking to excess.

If you have young children and you and your spouse are not getting along well, you need to make sure to protect yourself (both men and women). Have accounts set up so that you cannot pull out more than $500 at a shot without the other person co-signing. If your spouse drinks a lot, keep records. If your spouse does roids, pot, antidepressants (even if prescribed), has visited a psychologist/psychiatrist, has any history of mental illness, etc., keep records.

It is worse than you said. Here's the (additional) scoop.

Claiming domestic violence and getting a restraining order gives a woman such an advantage in court (that any competent lawyer should know about) that if a lawyer does not advise a woman to do just that, the lawyer can be sued later for malpractice.

Malpractice for not telling her she will get away with lying, and destroy the man easily by lying.

Every judge knows that virtually all accusations are based in legal advice and not reality. To prosecute without investigation to see if it is true makes the judge, the lawyer, and the ex guilty of perjury.

Understand that any good divorce contract will have a clause that payments to spouse/children will go up or down depending on income (or remarriage in that case of alimony). You are the kind of person that gives divorced dads a bad name - not wanting to support your children and doing anything to get out of it.

Yes, that is very true. That's one of the reasons I asked for a divorce when I did. My husband and I had been married 3 decades and I found out he had been cheating - took me awhile to get the proof, but I finally did. His last affair was with a woman he had worked with who lived in Whitewater, KS. She was a crazy (married) biatch who loved to trail ride mules and got my husband hooked on this as well. Of course, he always claimed there were other people with them and they were just friends (rolls eyes). He is older than me by a couple of years and said one day that when he turned 59 1/2 he was going to go out and buy the most expensive diesel truck and matching horse trailer (the kind with the living quarters) that he could find because he wanted it and deserved it (we are talking a couple hundred grand there). I read between the lines - he was planning on raiding our retirement accounts to buy crap for himself and then he would hide it and ride off into the sunset with his biatch. I had to get the divorce done and finalized before he reached 59 1/2!!! But yes, it worried me because I also knew of a lot of people who either cleared their accounts or had them cleared on them by the spouse heading into a divorce.

What we ended up doing was going into one lawyer we both agreed upon and who had a good reputation, telling them to split everything down the middle and giving a list of the personal items we each got and moneys from various accounts. It hardly cost us anything (at least compared to what it would have if we had each used different lawyers and fought over it). We both came out happy with the outcome and went our separate ways. That was one of the few things he ever did in our marriage that was not totally selfish. LOL - a better divorce than a marriage!!!

She calls the cops, tells them I beat her, and then strips down naked and smears blood all over herself. The cops show up, drag me out of bed, arrest me, and night court gives her a PFA, custody of the kids, and support payment.

Go from sweet dreams to being a homeless criminal in a few hours. Somebody coached her. Could of been a lawyer or some other lowlife scum.

All worked out in the end to my benefit, but that was one wild fucked up evening.

If a person is able to make charges against you, you should be able to demand use of a lie detector or DNA analysis. Did you ask about that at the police or talk to your lawyer? She has to prove you are guilty, but being banged up is evidence which makes you appear guilty even when you are not, so technically, in this day and age she doesn't have to prove it. You end up convicted on circumstantial evidence.

I delayed the case , documented her cheating with an 8 time felon scum bag

she got the whole case flipped around on her. ugly stuff

cost me a fortune that could have paid for kids to go to college.

It’s the “let me tell you what happened to me “ guy. I had to hire a private detective to run the story down and her own kid testified that I was asleep the whole time and that it never happened. The judge was cool, and new what the real story was.

I gave her a $175,000 property paid off free and clear, 3 vehicles, and all outstanding debts paid off in exchange for signing off my pension and annuity. Granted I had to withdrawal money’s from the annuity to make this all happen.

She self destructive shortly after that. I received a call from CYS one night asking if I could come take possession of my twins who were 8 at the time.

We bought a new house shortly after and have lived a wonderful life since. (18 years )

The ex wife disappeared about 8 months after the divorce was final and we have not heard from her since. Better than hitting the lottery.

Thank god I applied myself and had a $125,000/year job to make it all happen along with a little help from some loving parents.
