78 year old man stabs a burgler in his house and HE gets charged with murder

In our case over here, we have to wait up to 5 days now because of cuts...anything from Burglary to theft. You gotta do what you gotta do...

This 78 year old was cornered & trapped in the kitchen not knowing what the other burglar was doing upstairs where his wife was.. I'm sorry, I would of done the same thing to protect my loved ones.

Taking the "Devil's advocate" stance here.

Someone was killed, You have to speak to someone about what happened, therefore you arrest all the people involved. He'd been "arrested on suspicion of murder". He'd been charged with fuck all.

Had the burgler lived, he'd have been arrested and questioned too


Now that the police have spoken to the homeowner, they have released him on bail pending further enquiries.

No doubt when they've weighed up the info (especially the fact that it was a single stab wound, so the homeowner clearly didn't go all out for a kill), they'll come to the conclusion that sufficient force was used in self defence and I don't see any charges for the homeowner.




Personally, I'm saddened that one of the burglers got away. Should have got both of the fuckers. In my eyes the homeowner is a hero. 78 years old and taking on two young thugs. Nice one fella. Let me buy you a pint.

Here in Canada, people have killed others in self-defence and been acquitted.

The Criminal Code says you can use force to defend yourself, provided that the force is proportionate to the threat. That is, if the situation is such that any reasonable person would be in fear of being seriously injured or killed, lethal force can be applied.

Defence of property situations that don't justify lethal force unless the one who is committing the offence of theft threatens or moves to injure or kill the homeowner.

The Queen does NOT 'own Canada'. She is a figurehead and has no real power in Canada. At most, she rubber-stamps legislation created by Parliament, and is the official, but not actual head of state in Canada.

I have been burgled twice.. From the get-go, you know why somebody who should'nt be there is in your living room.

I hear some twat on BBC R5 calling in to say it is just silly for anyone to get involved, or strike out in these situations.

There was a case a few years ago.
A family caught some burglers and beat them with a bat.

They were prosecuted because they hit the burglers from behind as they were running away. Therefor they didn't need to defend themselves.

If they had hit the burgler in the face or chest they wouldn't have being charged.
