Hemmer wound up his pitch, noting, “T.S. Ellis III–great name by the way–was challenging the government’s case on Friday afternoon, saying, ‘This is outside the bounds of what the definition of a special counsel is all about; you’re trying to squeeze this guy Manafort in order to get to another target. And that target’s the president.’ You heard it.” Napolitano affirmed.

Hemmer then asked, “What did you think?” To which Napolitano replied:

Nothing. Because it’s just the personal opinion of the judge. There’s no evidence in the courtroom in front of him to justify that kind of an opinion. It drew enormous headlines over the weekend because it’s a political narrative with which the Trump supporters agree. It’s probably correct but it is irrelevant to his ruling on the matter.


Hemmer then tried his best to salvage the quickly-spiraling segment. He asked, “Now, so the attorney for Manafort from the very beginning, I believe, on day one he said this is gonna be our defense. ‘You are outside of your bounds.’ And you’re saying that’s good for an opinion but it’s not good from a legal standpoint. I understand that. The judge could still rule this way. Would Manafort be off the hook if that were to happen?”

Napolitano shut Hemmer down once again. He said:

No. If Judge Ellis dismisses this indictment on the theory that Bob Mueller did not have the jurisdiction to prosecute this charge in this venue in Virginia, then the local federal prosecutors in the Eastern District of Virginia will get an identical indictment from another grand jury and they will prosecute it. There’s no ‘Out of the woods.’

It takes it out of Mueller's hands and is a huge blow to his investigation and its credibility because it underlines that Mueller is politically motivated to go after ancillary charges to try to "get at" Trump, giving Trump more political cover against Mueller. It also emphasizes the point that Manafort has nothing on Trump, and his prosecution in E. Virginia is purely for his own misdeeds with no connection to Trump (which is what ought to be the case, given Manafort was under investigation for financial issues before Mueller received his brief from Rosenstein).

He is wrong. It’s not connected to Trump. Does it mean anything for Manafort? No - they can still bring it separate from SC.

Because the judge will have to follow the law and not succumb to his own desires and prejudices.
So what he says out loud in court is not an indication of what he will do.
Court watchers say that this judge is prone to criticizing the prosecution and making them work but ruling in their favor in the end.

Many of Manafort's crimes are financial and income tax related.
He probably has the same problems with his state taxes that he's being charged federally for and bank fraud can be prosecuted by states.

Why not blame him for all of the crimes of the Trump Campaign so maybe you could get Trump and family in the clear?
Why hasn't Trump and family blamed Manafort and Gates and some other people, saying that no Trumps knew anything about the crimes?
Saying the crimes didn't occur or that they don't exist or that everyone is out to get you isn't going to fly, you should have figured that out by now.

A federal judge in Washington DC is proceeding with the criminal case brought forward by special counsel Robert Mueller, regarding Paul Manafort, Trump's former campaign chairman.
US district judge Amy Jackson declined to throw out the case against Manafort, who faces two indictments from the special counsel.
"Given the combination of his prominence within the campaign and his ties to Ukrainian officials supported by and operating out of Russia, as well as to Russian oligarchs, Manafort was an obvious person of interest," the ruling said.

A federal judge in Washington DC is proceeding with the criminal case brought forward by special counsel Robert Mueller, regarding Paul Manafort, President Donald Trump's former campaign chairman.

US district judge Amy Jackson declined to throw out the case against Manafort, who faces two indictments from the special counsel. Manafort is charged in Virginia and Washington with tax and bank fraud connected to his lobbying work for the Ukrainian government and pro-Russia interests in Ukraine.

DC Judge’s Ruling Does Big Damage to Manafort’s Attempt to Get Case Dismissed


Judge Amy Berman Jackson of the United States District Court for the District of Columbia on Tuesday ruled against former Trump campaign chairman Paul Manafort by saying the investigation of alleged financial fraud falls within the mandate of special counsel Robert Mueller‘s Russia Probe.

This is notable because the Trump Administration, including Donald Trump, used Eastern District of Virginia (EDVA) Judge T.S. Ellis‘ pointed line of questioning about Mueller’s authority a week and half ago in a separate fraud case to suggest that even a federal judge recognizes that a witch hunt is afoot.

USA Today reporter Brad Heath tweeted out Berman Jackson’s reasoning for denying a motion to dismiss this afternoon.

She said: the Manafort indictment falls “squarely within” Mueller’s authority; the investigation was “logical and appropriate; special counsel regulations do not “create any substantive rights for the benefit of individuals under investigation”; Mueller would have been “remiss” to ignore this “obvious potential link” between Manafort’s alleged Ukraine dealings and Russia’s election interference.
