You could be born in the Kremlin nursery and if your mom or dad is an American citizen at time of birth then the baby is automatically a U.S. citizen. That's the law. Since BOTH of McCain's parents were citizens he is definitely irrefutably 100% a U.S. citizen, like it or not. Correction: The one parent who is a legal U.S. citizen with a child born elsewhere is the father, especially if he is currently in service to the U.S., such as Ambassador, Secretary of State, etc., or serving in a branch of the U.S. Armed Forces. That probably applies to mothers now who are in service to the U.S. outside of the U.S.
