Sorry, but you are incorrect on this. For any appointment of a Cabinet level position, the Senate must "advise and consent."

While it would make sense that a previously confirmed nominee to another position would be VERY hard for the Senate NOT to confirm, it is possible!

The Senate could simply say "We think he was fit to be (x position) but we do not think he is fit to be Attorney General.

That only applies to permanent appointments. The President has two alternative methods:

- If the Senate is in recess for more than 10 days, the President can make a recess appointment, which lasts until the end of the current Congressional session.

- The President can designate a temporary replacement (e.g., Acting Attorney General) from among anyone in his administration who has already been confirmed by the Senate. If I recall correctly, this expires after 180 days.
