Need Some Legal Advice
Ok, here is the deal. Years ago, in 2012, I was serving in Afghanistan. One night, I was alerted to a fire right outside of our sleeping quarters. I rushed out there to see what was going on and saw my men putting out a huge fire stemming from a pallet. I rushed up to the fire as they were putting it out with dirt and ingested a lung full of the fumes and smoke. It smelled and tasted like chemicals and I quickly backed away. Later I would find out that the fire was a pallet of military grade, lithium battery packs.

I have since been diagnosed with stage 3b, rectal cancer. The doctors have told me that the cancer is due to environmental factors and that is the only time I exposed myself to high doses of chemicals.

If I win my case to service connection from the VA stemming from this event, can I then turn around and sue the battery manufacturer who made the batteries for the military?

Thanks, and sorry for the long read...

Re: Need Some Legal Advice
When you join the military you give up all Legal rights and actually give them permission of your own free will to experiment on you with no penalties even if they get you killed.

You did that of your own free will.

In Western Law anyone can opt out of a contract for any reason within 3 days of signing. This is why they hold you to contract because you have every chance to get out of that contract.

The only ground you have is you were denied legal knowledge before you signed the contract.

There are 8 things which make a contract legal. Look them up and see if the Military violated any of them.

Otherwise you are screwed and the only justice you will ever get will be from you own hands. That should not scare a solider boy.

No, The military did not properly "store" the batteries.

someone tried to sue Lucky Gunner cause his daughter was killed by a bullet sold by LG. not only did he lose the case but the judge ordered him to pay LG legal fees of $100,000. so be careful with lawsuits.....

Thats terrible. Sorry OP. I wish I knew the answer. I hate the cliche but I do appreciate and respect your service to America and aiding the Afghan people. Whatever people might want to say I believe it was a noble cause and intent.

I don't even know where to start looking. I have some pictures from the day after, but it just looks like a pile of smoldering dirt. I know the batteries were used for MRAP's communication equipment. I guess I can start there to find out. I will also reach out on social media to the guys I still know who serve to see if anyone can help me out in identifying batteries in our inventory from 2012.
