Jose Gonzalez, father of Cirino Gonzalez publicly announces to his local news media that he plans to stand by his son’s side. He believes as do we all that the cause is righteous, it appears that he wants to support his son in his patriotic efforts in preserving liberty from unjust government tyranny that attempts to enforce laws that do not exist.

If it were not for these brave people like Cirino and his father Jose with the physical courage, and moral fortitude that it takes to make the stand for what is righteous and just by putting their lives on the line, then I just don’t know where we would be at as a nation today. If the government chooses to turn these people into martyrs for the cause of truth in taxation, there will be an outcry so large, loud, and persistent that it will reach to the very heavens themselves!

Now is the time folks if you are able, please travel to N.H. and join Ed, Elaine, Reno, Jose, and Randy Weaver among many others in this monumental stand for truth! Remember this is a serious decision to make, if you plan on going down to the home, you must be ready to stand your ground against this government tyranny and corruption. You can be a very important part of history, so if you are both physically and mentally prepared to make the stand, now is the time!

N.H. Home With Tax Protesters

A 30-year-old Alice native has joined a group of tax-protesters who have barricaded themselves in a home in New Hampshire, in what some fear may soon become a standoff similar to the one that unfolded in Waco, Texas, in 1993.

Cirino "Reno" Gonzalez, 30, of Alice is one of more than a dozen people who have joined a New Hampshire couple, Ed and Elaine Brown, in a protest against the federal income tax.

The Browns, who in April were sentenced to more than five years in prison after they were convicted of multiple charges related to tax evasion, have refused to surrender to federal marshals and are currently living with several supporters in a home in Plainfield, N.H.

An Alice Native

Gonzalez was a student at Alice High School before dropping out in 1993 and obtaining his GED. He studied law enforcement at a community college and worked as a clerk in the Jim Wells County Sheriff's Department for a short period of time, and worked at the Thunder Road night club, his father said.

A divorced father of four children, all under the age of 11 years, Gonzalez is the son of Jose M. Gonzalez, also of Alice.

Cirino Gonzalez joined the Navy in 1995 and received an honorable discharge in 2003. Following his return to Alice, he accepted a job with a civilian contractor working in Iraq, where he repaired weapons for the military before returning to Alice, his father said.

Asking Questions

Cirino Gonzalez said Tuesday the journey that brought him to New Hampshire began in 2005, when he started questioning the reasons behind the war in Iraq. Questions about funding for the war led him to investigate the federal tax system, and in particular the operation of the federal reserve.

During the course of researching those issues on the Internet, Gonzalez found information that led him to believe the government does not have the legal authority to collect federal income taxes. Gonzalez said although he found many like-minded people on the Internet, that belief has cost him in his relationships with friends and family.

"Most people do not want to deal with this initially. I've lost a lot of friends because they just turned tail while I was talking to them, and they went away," Gonzalez said. "Later, they came to me and told me that what I was saying was true."

Gonzalez compared the government to a Mafia organization, and said people continue to pay income taxes because they either do not understand the "truth" or they are afraid of reprisal.

"Why are so many people put in jail, having their families destroyed, their homes taken away, their land ripped away from them when there is no law stating they are required to pay protection money to the government?" Gonzalez said.

Although Gonzalez said his primary question is "where is the law?" related to federal income tax, he took issue with many other legal questions during a phone interview Tuesday.

Over the course of more than an hour, Gonzalez questioned the legality of free speech zones, the purpose and effectiveness of the Department of Homeland Security, the need for banks to obtain Social Security numbers, the wording of firearm laws, the effectiveness of the United States military and the legality of seat belt ordinances.

Joining The Browns

In January, Gonzalez saw a short news story related to the Browns' case on television and followed up that story with research on the Internet, including reading blog sites set up by the Browns and their supporters.

After communicating with them for some time, Gonzalez made the decision to drive to New Hampshire the weekend before Easter to give them his support.

"It takes your personal integrity to stand up and stand with the people who are being unjustly accused of things," said Gonzalez from the Browns' New Hampshire home. "I caught hell from all of my family. Basically I tried to tell them something that they initially couldn't grasp."

The Home

The Browns' home is located on a hilltop in a 110-acre, heavily wooded estate. The large home was reportedly built with 8-inch thick concrete walls, has a private well and has the capacity to generate some electricity. A five-story-high tower sits atop the home, with a 360-degree view of the surrounding area. Ed Brown has told reporters the home has a large stockpile of food, and supporters have reportedly brought more supplies in recent weeks.

A Supportive Father

Jose M. Gonzalez, Cirino's father, is a strong supporter of his son's decision to move to New Hampshire, and has been following the case.

Jose M. Gonzalez served in the U.S. Army for six years, and has a bachelor's degree from Texas A and M Corpus Christi in psychology and sociology. He is working on a master's in counseling, with an emphasis on family counseling, and currently works as a counselor at the Alice Counseling Center.

Jose M. Gonzalez said he believes actions by the U.S. Marshals last week, in which they reportedly used armored personnel carriers to execute a warrant on a business owned by the Browns, are signs the confrontation might be moving toward violence.

"Our primary goal is to inform the American public of the truth, which is there is no federal income tax in America," Jose M. Gonzalez said. "Personally, I don't want my son to die trying to get this message across. So I will drive to New Hampshire to protect him, if I have to."

Jose M. Gonzalez, who has not paid income taxes since 1997 he said, empathizes with the Browns' situation and agrees with their cause.

Moving Toward Violence?

The Browns and Cirino Gonzalez have informed law enforcement officials that if any move is made on their home, they will use lethal force against the federal agents.

Gonzalez brought several weapons with him to the home, and announced on his myspace.com page that he had recently purchased a .50-caliber rifle.

When asked why they would choose to fight against federal agents, Cirino Gonzalez said they were "taking a stand" to protect other Americans.

"If we don't stand now, while it is at our doorstep, if we don't stop it here, it's going to be at your doorstep," Gonzalez said.

Jose M. Gonzalez said he was afraid for his son's safety, and was considering driving to New Hampshire to join Cirino. Although his occupational speciality in the Army was as a truck driver, Jose M. Gonzalez said he is reluctant to join the group in New Hampshire because he might be compelled to use other information he learned in the service.

"I had trained as a...[I'm not supposed to say it, but I guess I've been out long enough]...as a specialist in nuclear, biological and chemical warfare," Jose M. Gonzalez said. "This is what scares me. I know how to kill people in mass quantities. I don't want to go up there."

A Waiting Game

U.S. Marshal Stephen Monier, who has been charged with the arrest of the Browns, said Wednesday the Browns are attempting to work outside the law.

"They had a trial in front of a jury of their peers, and they were convicted on all counts," Monier said. "No man is above or below the law, and they don't get to decide what the rules are."

Monier also discouraged anyone from joining the Browns, and warned Cirino and Jose could face separate criminal charges.

"Aiding and abetting people in their continuing obstruction of justice, in this case the Browns' refusal to surrender and submit to authorities, is a separate felony offense," Monier said. "Bringing them weapons, they are convicted felons, is a separate criminal offense.

"Reno is not helping the situation, he is hurting it."

Although he acknowledged that he had cut power and phone lines to the house, Monier said he had "no intention of storming the house," and was prepared to take as long as necessary to resolve the situation peacefully.

"If I wanted to kill Ed Brown, I would have done it a long time ago. But that's not our objective. Our objective is to take them into custody without causing any harm," Monier said. "The Marshal Service has been around 216 years. Do you think we're going anywhere?"

This is umbelievable!!! It is only going to cause more of the same thing to transpire if the raid takes place. This has come to a really sad and scary point. It seems like it could have been handled with a little more intelligence before it arrived at this point. America needs a form of governing that people can look up to with respect, and sadly this is not the way to accomplish that goal.

What just happened to the other thread on this. I find this very interesting. I tend to side with those who pay their taxes, BUT! and that's a big but. I'm curious. In freedom to fascism by Aaron Russo it was my understanding someone used the same stance as the Brown's and in a court of law won. Now, doesn't this set a precendent and shouldn't this ruling be followed. Or shouldn't it be taken to the supreme court. I'm wondering is there something most don't know that some are afraid if it gets out and people know. Well you know what I'm getting at.

I think most americans would pay taxes. BUT! being swindled?

Well, if there were such a case, and the situation was the same and the "show me the law" defense was used and some guy got off on those grounds, then why isn't that same defense being used in courts nowadays?

That in itself is a strong indicator (to me, anyway) that there isn't any precedent.

Duncan, I will profess my knowledge of law runs about as far as television takes it. But, I'm curious. Have you watched freedom the facism? Do, it's free online and it was my understanding that a farmer used this same stance and won. Also the Brown's are pulling this out. Is it being silenced? Just imagine the repercussions if this ever got out.

Um, I'm just trying to understand. Why do people refer to other cases? Is it so two people can be tried for breaking the same law with the same convicitng evidence and one person found guilty while the other let go?

It just doens't make sense to me, but what do I know.

I pay my taxes and have no problem with it. It's the way the legal system is working that interest me the most.

As a member of the armed services of the United States and as an attorney, he twice swore an oath to uphold and defend the Constitution from all enemies, foreign and domestic, and Tommy Cryer is still honoring those solemn oaths. Unfortunately, that puts him at odds with a federal prosecutor, the IRS, a misled grand jury, and a US District Court judge. On July 9 the battle between America's fundamental law and the most corrupt segment of the federal government begins in a federal courtroom in Shreveport, Louisiana.

Among the critical issues to be confronted are these:

No law makes Mr. Cryer liable for the income tax, and no law makes Mr. Cryer’s earnings taxable under the income tax law, yet some criminals in government claim that doesn't matter.

They also say it doesn't matter what the U.S. Constitution and the U.S. Supreme Court say the federal government cannot tax.

They want us to believe that it doesn't matter that the U.S. Supreme Court has repeatedly held that labor is property, which the government can only tax through the States.

They want us to overlook that the U.S. Supreme Court has repeatedly held that the right to earn a living through any lawful occupation is a fundamental right, exempt from taxation.

The IRS has done its best to bury Mr. Cryer, to impugn his reputation, to put him out of business, and to make him abandon his oath and surrender to their coercion. THE BIG LIE: The Federal government has been telling people that they must file returns and pay income taxes on their wages, salaries and fees they gave up their labor, time and a large part of their lives to obtain, but those earnings are Constitutionally EXEMPT from the income tax. TRILLIONS OF DOLLARS HAVE BEEN STOLEN FROM HOUSEHOLDS AND FAMILIES: Money that you earned, paid for with your labor and industry and that you have a Constitutional right to keep and use for your family, your children and your community.



THE TRUTH: The income tax law, although it is carefully written to APPEAR otherwise, does not actually tax your wages, salaries and fees that you earn yourself because the Constitution does not allow the federal government to tax those earnings.



The Sixteenth Amendment DID NOT authorize the federal government to tax your PERSONALLY earned wages, but only that part of your wages that is PROFIT, or GAIN above and beyond what you gave up in order to receive them. Can you say what part of your wages are above and beyond your personal investment in earning them?



Neither can the government. So it LIES to you by saying in PUBLICATIONS, like its Form 1040 Instructions, (WHICH ARE NOT LAW) that you must report and pay taxes on ALL of your wages . . . even that part that is not profit.



The Supreme Court has, over and over, told the government that it cannot impose an income tax on anything but the profits and gains. Although the law does not tax your wages, the government PUBLICATIONS claim that the "basis" or "cost" you give up to receive your wages is worthless, ZERO!



THE LIGHT OF TRUTH: Tom Cryer, a lawyer in Shreveport , Louisiana , spent two years researching the entire history of the income tax. He has been an avid student of the Constitution his entire life and he knows THE TRUTH.



He has challenged to IRS and the federal government to tell the truth and to stop taxing personal earnings.



THE GOVERNMENT'S ATTEMPT TO DOUSE THE LIGHT: The IRS and the federal government is now trying to shut Tom up, to lock him away. They've accused him of tax evasion, even though they had to intentionally avoid the facts to do so [see the story]. But the frightening thing about this is that Tom does not have the resources to fight, HE NEEDS HELP and he needs a lot of it and HE NEEDS IT FAST! Trial is set for April, 2007, and a lot has to be done between now and then.

WHY IS THIS SO IMPORTANT?



Tom believes that We the People are the dog and the government is the tail, not the other way around. We are entitled to be told the truth up front, to have our laws clearly and plainly stated, not hidden in omissions, vague references and tons of obtuse verbiage.

Attorney Challenges Income Tax Law

Constitutional History in the Making



Longtime Shreveport , Louisiana , attorney, Tommy K. Cryer, is no stranger to conflict and controversy. The Hall of Fame attorney, an honor graduate of LSU Law School and member of the prestigious Order of the Coif, has a reputation for taking on issues no one else would and, on a number of occasions, he has made new inroads in the legal world. But now he has thrown down the gauntlet in front of the mother of all 800 pound gorillas, the Internal Revenue Service, and the mama gorilla has picked it up. The only thing certain now is that someone is going to be hurt.



The story began over a decade ago when a friend told Cryer that the income tax was a sham. Cryer did not believe a word of it and thought his friend had gone off the deep end. Learning that his friend had decided to stop filing tax returns, Cryer determined to research the matter, show his friend where he was wrong, and keep him from getting in trouble with the IRS. That is how a two-year research project began, but it did not turn out the way Cryer expected. Sporting a wry grin, Cryer said "That just goes to show you that no good deed goes unpunished."



His research not only included the tax laws themselves, but went past the first income tax in 1861 to the drafting of the Constitution and included reading hundreds of cases, Congressional archives and tax laws from 1913 to present. Cryer learned that although his friend had only a piece of the picture, he was right. "The Tax Code and its regulations are carefully and," he adds, "ingeniously crafted to deceive," said Cryer. He explains that the answer is not in what the laws say, but rather in what they do not say, and those provisions that are revealing are either hidden within tons of verbiage or behind double and triple negatives. And, more importantly, he says, he knows why.



So Cryer decided he would also stop filing returns and would challenge the IRS if and when it came to call. Cryer said "Once you've taken an oath to uphold the Constitution and the law, obeying the law is only half the job. You also have to be willing to fight for it. I've not only sworn to fight for the Constitution as an attorney, as a former officer in the Army
I've sworn to die for it."



In 2001 they came, demanding information and returns. Cryer advised them that if they could show him any law making him liable or making his revenues taxable he would file any tax returns required by the law.
They could not show him any law.



Instead, the IRS began to pelt Cryer with a series of summonses, gathering up all banking records. It even subpoenaed Cryer's secretary into the office for interrogation. But Cryer did not budge. Frustrated, the IRS called in their criminal investigations division, CID, and Cryer told them the same thing, "Show me the law that makes me liable or my revenue taxable and I will file."
They could not show him any law.



CID began the summons pelting all over again, but Cryer filed a petition to quash the summonses, which even included summonsing his college and law school records from almost forty years ago. "I suppose they thought the records would show I was some kind of kook or an idiot, but all they would have found is that I graduated from college in only three years and that I graduated from
law school in the top of my class." Cryer said.



So, CID called in the Justice Department (DOJ) and the sabers began to rattle. Cryer met with the Assistant U. S. Attorney and an official of the IRS and reminded them that all they need do is show him the law. They could not show him any law, either.



"The CID and DOJ both responded only with 'your position is frivolous.' I had never stated a position, so how could they know whether it was frivolous?" Cryer said, "Imagine my sending you a bill for $1,000 and when you call me and ask what the bill was for I simply said, 'that position is frivolous, just write the check and send it in.' What would you say? Would you write the check?"



"After that they circled for awhile, apparently not sure what to do with or to me," he continues, "but when I went public with a book I'm writing, LIBERTY LOST, A Treasure Map to Buried Freedom, about how the federal government has escaped its constitutional limits and how to put it back, that broke the impasse. Within two months they accused me of tax evasion. Do I look like Al Capone? Well, I am a bit overweight and he was kind of chubby, too."



The two count indictment accuses Cryer of concealing income in a trust in 2000 and 2001, keeping himself "below the radar." But in 2001 he was not only on the radar, he was in the cross-hairs. Cryer, whose wife, Carolyn, was severely disabled, was worried that if anything happened to him Carolyn's son would have her destitute before the grass grew over his grave. He set up the trust in 1993 and opened brokerage accounts in hopes of parlaying the seed money he could muster up into a fund to provide for her and safeguard the money. Carolyn died in 1999, but he continued to trade in the accounts.



"They subpoenaed every record on me you could imagine, they even got into my dry cleaner's account, but they did not subpoena the brokerage account records. They did not want the facts, just an indictment. If they had they would have known that the trust not only had no income for those two years, it lost money both years, but they did not want to know the truth because that would prevent them from accusing me." he said.



Cryer says that it has already been an eye-opening experience for him, "It's been revealing. I've had agents tell me the law did not apply to them, so I suppose they think they are above the law. Another, challenged with having failed to follow IRS procedures explained that the procedures are binding on us (the peasants?), but that the IRS does not have to follow its own procedures unless it wants to. After effecting a legal stay on the CID summonses, a CID investigator called the banks he had summonsed and when they pointed out that they were stayed and not allowed to release records until the court ruled, he demanded they send him the records anyway, law or no law. After I made full disclosure of all records, saying show me where any of this is taxed, they sent agents out to 'visit' with my clients, and you can imagine what effect that has had on my practice. But the ride is going to get a lot bumpier from here on. I'm threatening a lot of rice bowls. Someone may actually have to
go get a job and work like the rest of us."



Well, now the worm has turned. Cryer filed a motion to dismiss both counts against him, showing that the law, as it is written, does not make him liable nor tax his revenue from his law practice. The motion takes another bold step, however, revealing that the income tax, as applied to wages, salaries and fees personally earned, is unconstitutional, citing four separate grounds for the unconstitutionality of the law as to almost every citizen's
revenue personally earned.



According to Cryer, the law, which is carefully drawn to stay inside the Constitution, does not actually tax personal earnings, but the IRS publications, no more law than Time Magazine, say it does and by collecting taxes on personal earnings it has violated several fundamental constitutional restrictions. He says that nearly a trillion dollars is siphoned, illegally, away from families and households every year, although their wages and salaries, including bonuses, are exempt from taxation under the Constitution. "I wish there were some way I could have taken this case on a 1/3 contingency," he joked.



Due to the adverse publicity and clients' fear of being targeted if they get too close to a target, Cryer says his practice has suffered immensely, placing him in a severe financial strain. "Getting the government off everyone's back and out of their pockets is going to be expensive and, frankly, I don't have the means," Cryer said, "but somehow I am going to finish this. I am totally convinced that this is why I am here on this Earth, this is why I am a lawyer, and
since it's meant to be, it will be."

"The obligation to be enforced is the liability for the tax."

Section 280(a)(1) provides the United States with a new remedy for enforcing the existing 'liability, at law or in equity.' The quoted words are employed in the statute to describe the kind of liability to which the new remedy is to be applied and to define the extent of such liability. The obligation to be enforced is the liability for the tax. Russell v. United States, 278 U.S. 181, 186 , 49 S. Ct. 121; United States v. Updike, 281 U.S. 489, 493 , 494 S., 50 S. Ct. 367. The proceeding is one to collect the revenue. That Congress deemed the section necessary in order to make the tax-collecting system more effective is established, not only by the fact of enactment, but also by the reports of the committees. 4 [283 U.S. 589, 595] The right of the United States to collect its internal revenue by summary administrative proceedings has long been settled. 5 Where, as here, adequate opportunity is afforded for a later judicial determination of the legal rights, summary proceedings to secure prompt performance of ecun iary obligations to the government have been consistently sustained. Compare Cheatham v. United States, 92 U.S. 85 , 88-89; Springer v. United States, 102 U.S. 586 , 594; Hagar v. Reclamation District No. 108, 111 U.S. 701 , 708-709, 4 S. Ct. 663. Property rights must yield provisionally to governmental need. Thus, while protection of life and liberty from administrative action alleged to be illegal may be obtained promptly by the writ of habeas corpus, United States v. Woo Jan, 245 U.S. 552 , 38 S. Ct. 207; Ng Fung Ho v. White, 259 U.S. 276 , 42 S. Ct. 492, the statutory prohibition of any 'suit for the purpose of restraining the assessment or collection of any tax' postpones redress [283 U.S. 589, 596] for the alleged invasion of property rights if the exaction is made under color of their offices by revenue officers charged with the general authority to assess and collect the revenue. 6 Snyder v. Marks, 109 U.S. 189 , 3 S. Ct. 157; Dodge v. Osborn, 240 U.S. 118 , 36 S. Ct. 275; Graham v. Du Pont, 262 U.S. 234 , 43 S. Ct. 567. This prohibition of injunctive relief is applicable in the case of summary proceedings against a transferee. Act of May 29, 1928, c. 852, 604, 45 Stat. 791, 873 (26 USCA 2604). Proceedings more summary in character than that provided in section 280, and involving less directly the obligation of the taxpayer, were sustained in Murray's Lessee v. Hoboken Land & Improvement Co., 18 How. 272. It is urged that the decision in the Murray Case was based upon the peculiar relationship of a collector of revenue to his government. The underlying principle in that case was not such relation, but the need of the government promptly to secure its revenues.

The government has no right to collect any tax for which there exists no liability statute (law). Note that this issue was never raised in Phillips v CIR. If you don't raise the point, you lose.

This is umbelievable!!! It is only going to cause more of the same thing to transpire if the raid takes place. This has come to a really sad and scary point. It seems like it could have been handled with a little more intelligence before it arrived at this point. America needs a form of governing that people can look up to with respect, and sadly this is not the way to accomplish that goal.

How would you propose the government deal with people who break the law?
