The Electronic Frontier Foundation is tracking some cases, including USA v. Pen Register, regarding government tracking of an individuals such as pedophiles & often political activists.

The FBI appears to have begun using a novel form of electronic surveillance in criminal investigations: remotely activating a mobile phone’s microphone and using it to eavesdrop on nearby conversations.[citation needed] The technique is called a “roving bug,” and was approved by top U.S. Department of Justice.[citation needed] A mobile sitting on the desk of a politician or businessman can act as a powerful, undetectable bug.

They can't use your phone against you if it doesn't have power.

While the battery is in, the phone is powered. Regardless of whether you have it switched on or off. Hoever taking the battery out while having dubious conversations doesn't solve this problem. It is possible for your phone to have onboard power (for keeping settings and so forth from resetting) and I remember an urban legend about phones having secret power stores in case of emergency. Though these power stores are also extremely limited. ie 2 mins talk time or something. Due to the nature of static memmory, I would suggest that there is no need for onboard power or secret power stores.

In conclusion I would suggest that if you are worried about being spied on, firstly take the battery out of you phone. This is good enough for me to be reasonably happy. If you're worried about the secret power stores etc, then I would suggest wrapping your phone very well in something very sound proof. (I used to be a technical specialist for a telecomunications company and those mics are VERY sensitive even if you don't think so. I've heard what they can do.)

This technology was around in the 70's or earlier. It is a device that dials up a phone and without causing it to ring.
Realise that before your phone rings, the connection has already been established.
Before cell phones, the authorities could only bug you in your places where there was a phone. Now they can bug you anywhere. Police informants don't have to carry mikes.
Of course information gleaned from this bugging can not be used in court. When the police are hearing enough incriminating traffic, then they apply for a wiretapping warrant to record admissible evidence.
