Texas bill would allow state to sue social media companies like Facebook and Twitter over free speech
A bill before the Texas Senate seeks to prevent social media platforms like Facebook and Twitter from censoring users based on their viewpoints. Supporters say it would protect the free exchange of ideas, but critics say the bill contradicts a federal law that allows social media platforms to regulate their own content.

The measure — Senate Bill 2373 by state Sen. Bryan Hughes, R-Mineola — would hold social media platforms accountable for restricting users’ speech based on personal opinions. Hughes said the bill applies to social media platforms that advertise themselves as unbiased but still censor users. The Senate State Affairs Committee unanimously approved the bill last week. (Update: The Texas Senate approved the bill on April 25 in an 18-12 vote. It now heads to the House.)

“Senate Bill 2373 tries to prevent those companies that control these new public spaces, this new public square, from picking winners and losers based on content,” Hughes said in the committee hearing. “Basically if the company represents, ‘We’re an open forum and we don’t discriminate based on content,’ then they shouldn’t be able to discriminate based on content.”

So they are going to sue a private company and disallow there right to operate as free press to protect another group of snowflakes. Lol Sets a dangerous precident crating a situation were companies must follow state mandate allowing them to control media. Stupid.

Do you people not see where this could lead? Think about Chic fil a or Hobby Lobbies practicies of not hiring or promoting ideals they disagree with. What do you think will happen to companies like that if this passes? Organizations with more so called right wing views would be forced to accomidate the left as well. The government has no business telling private companies or citizens what information they can and cannot allow. If you dont like Facebooks policies put on your big boy pants and create another platform for those views, you arent entitled to change the way facebook operates.

Its a social media servicee for crying out loud. All Im saying is this sets a dangerous precident. Government would essentially be censoring a private companies right to conduct business as they see fit. No government intervention ever works with something like this. Do not give them more power to control the media. Im telling you this is a very bad idea and will have terrible repercutions.

The way to tackle it on a state level would be to make political affiliation a protected “status” like sex, race, religious affiliation, etc. and then sue them.

I’m all about small government but when democrats are in power, Bezos, Jack Zucker, media have the power to overthrow an election to keep power, that’s a motherfuckin problem. Hint, it’s been attempted.

Its a private company. It would be different if the Texas or U.S. government was censoring people. Which in some cases they do but this is unrelated.

Let me give you an example of how this might backfire on people with certain ideals.

Remember a few years ago when Reddit had a problem with what was an underage section where users posted content that was completely legal but was brought under scrutiny by CNN?

Well if a bill like this gets passed it would essentially give people who are interested in posting such content a free pass to sue reddit to allow their LEGAL content back on the site.

Do you think that should be allowed? Even though Reddit removed the sections due to the bad fallout and loss of business from it?

Do you think Facebook should be required to post content which they deem as a violation of thier terms of service just as Reddit has done?

Hell GLP falls under this law as well. Some leftist group like ANTIFA could claim that GLP was discriminating them by removing their posts.

This bill all sounds fine and dandy at first but it will end up biting a lot of people and businesses in the ass.

Alot wrong with this thesis.

The issue is they DON'T uniformly enforce their TOS.

They selectively, and rather arbitrary, censor based solely on political opinion. The facts are quite clear in the matter. They allow Hammas and Antifa pages to stay up, while censoring someone like Paul Joseph Watson? They allowed the covington kids to be ubiquitously smeared by left-leaning news outlets without any TOS violation. They did the same with allowing the 'fake news' Russia meddling hoax to go on for years.

This is clear gerrymandering.

Further, they ceased being a 'private' company when they did a public IPO, accepted public grants, and promoted themselves as a 'platform' for public discourse. In fact there are supreme court rulings on old shopping malls trying to censor certain people for passing out political flyers while not applying the rule to others, and the shopping mall lost the suit based on the fact that the company was now acting in the capacity of a 'public square'.

I'd have no problem if they actually enforced their TOS uniformly, but that isn't the case.

Hell GLP falls under this law as well. Some leftist group like ANTIFA could claim that GLP was discriminating them by removing their posts.

This bill all sounds fine and dandy at first but it will end up biting a lot of people and businesses in the ass.

If it's an open forum, you prefer to discriminate based on content?

So you would be completely fine with Reddit allowing sections with such content back up? Because that is what will happen if something like this passes. Same goes for Facebook and Twitter.

You see all of the things that you might deem bad and unsavory would also be protected under such an amendment to private business function.

The 700 Club might have to start allowing Gay married couples to post their opinions to that website.

I have tried to make my point as clear as I can. I do not support what the social media websites are doing but they have the right to operate freely and they have violated no laws.

So what do I do? Stop using their services, simple as that. No need for "Government" intervention, they are not here to help you.
