Order in one hand and shit in the other.

Unless there is a legitimate reason for an "investigation" there is no requirement to "comply" with a police officer. He's just another person, subject to the same laws as everyone else.
Imagine if we went to the officers house and held him at gunpoint for doing yard work.

Truth is they were hoping he throw the trash clamp if they kept egging him on.
there was no cause for any of this and those officers should be charged with felony menacing and assault a deadly weapon.

Police need to learn the limits of their powers better
That's means probable cause, a warrant, or observing a crime without fishing for it.
 Quoting: Anonymous Coward 72043142

If those guns come out of them holsters it should be to shoot a deadly imminent threat when no other solution exists, not to try to force compliance.

Chickenshit move that gets a lot of innocent people shot.

This is not what self defense is and typically drawing weapons to force compliance is felony assault with a deadly weapon and possibly kidnapping.

Police must be held to a higher standard of obeying the law, not a non existent one, and a full study of the Constitution (which is the law which limits their powers) should be required for all cops

Wonder if the man filed a civil lawsuit against the department and city... he'd win and the city would most likely settle for $$$ out of court.

What a shame cops like this idiot give a bad name to other goo LEO's.

If that clamp is a weapon, then why do the cops here give the to the prisoners that are out picking up litter on the side of the road? I regularly see 10-15 prisoners with those clamps with one cop watching them.

The whole thing would've been over in two seconds if the guy didn't go hysterical and calmly explained the situation to the cops.
 Quoting: Hawkeye86

He didn't get hysterical! He was very polite. He gave his address and his name. He didn't even need to do that much, being on his own private property.
 Quoting: Pooka

For most of the video he was yelling at the cops (being hysterical). The best way to deal with cops is to be calm and clear up any confusions. If you yell at them then it makes them suspicious that you're hiding/guilty of something.
 Quoting: Hawkeye86

He was making some good points. The cop should have listened and backed off. Deescalate. Now he doesn’t have a job. Sucks to be like that, not willing to listen and change course when a citizen is making a valid point.

The guy was acting erratic. Just because he lives there doesn't mean he might not be on drugs freaking out thinking he's about to get busted & pull out a gun. You know what would have been a better option? "Officer am I free to leave" if yes go inside & clean up another day. If no then slowly put down whatever you're holding, back/move away from it (is there a weapon in the bucket?) sit down & do what they say-you are being detained. Yes it is F-ed up but that is the world we live in.

He waived his right to sue the city and made a deal. Hopefully he didn't also waive his right to sue the former officer in a civil suit. Part of the deal that he made was to compel the former officer to resign.

In the USA, we have approximately 1,100 rights and even more privileges and immunities. The only ones you have are the ones that you can articulate and claim. Too many people don't care and/or freely waive their rights in general and right to remedy.

The investigation into a Boulder police officer who tried to detain a black man cleaning trash around his home has been completed, and the police department has released all related body camera footage and reports .

On Thursday morning, the city of Boulder announced the investigation had closed and the officer, who had already resigned, had not racially profiled the man.

...

2nd Link explains why the officer was there. Most citizens would simply comply recognizing the cop was there doing his job but not these days in certain communities and or so many people.

Today, so many want to argue their rights in the streets instead of just responding to a simple request because they immediately go to this "I know my rights" defense. It's dangerous....

Are they right? Well, yes and no. Sure, the guy was on "his" property and yes he as not doing "anything wrong" but when police have had numerous calls of thefts in MY neighborhood I would certainly WELCOME their additional patrolling of my neighborhood and if they wanted to make sure I belonged where I claim I do but again, that is me.

How did we get here? Well....honestly, I think the main culprit are the media and politicians who are bent on sowing seeds of dissent and distrust in order to gain or remain in power and of course lets not forget, there is LOTS of money in sowing this kind of division.

I don't know the answer but the way things are going one thing is certain..more and more of the "good cops" are either going to leave or just never apply for the jobs because who in their right mind would want to subject themselves to the abuse and lack of support along with the constant threat of violence and or criminal charges being levied against them at the drop of a hat? Answer...nobody
 Quoting: FeedYourHead

He gave the cop the only bit of id he had.
Dont typically carry my wallet when im doing yardwork myself.

If you can't see the problems here as well, then it will take until you start getting harassed for no reason.

8 cops...for standing with a bucket and a clamp...
...in your yard...
Weapon drawn...

Aren't you patriots like "dont tread on me"?
 Quoting: Anonymous Coward 77645551

Where did I say I didn't see the problems here?

Harassed for no reason? Hate to tell you but I have been harassed (TWICE) in my life to a level MUCH higher than this man and in fact, in one case for the same reason.

Once I was placed in a choke hold and pulled thru a fence and arrested (disorderly conduct for failure to id) when I had committed no crime of any kind...I thought the cop was going to kill me.

Another some kid had told the cops I had "kicked him". I was walking out of my apt to go wash my car when the cop pulled up, said NOTHING to me but walked up to me and placed me again in a choke hold and took me to the ground, Shouting..."So you like kicking little Kids"...again, this cop didn't say one word to me before doing this so don't talk to me about police ABUSE...I understand it very well.

I will look again at the video but I didn't see a "drawn weapon"...I saw the officer with his hand on his weapon..that is NOT a drawn weapon and yes, I have experienced this before as well. (EDIT) In looking again it does appear the officer actually DID draw his weapon and was holding it at his side. It is my understanding that is against procedure in most police departments as you are not supposed to draw a weapon unless you intend to use it. Of course I'm no attorney and I don't that if that is factual or not.

Had a crazy x-wife called 911 once and then the dumb bitch hung up....well, guess how the officer who showed up at my door reacted to that...yep, with his hand on his gun!

Did I scream about my rights? Did I complain to anyone about him threatening me in my own home? NO...I understood and actually turned to the dumb bitch and told her to look, this is what SHE caused because of HER actions!

I could post videos of cops in similar situations we are discussing here who are DEAD now because they were NOT ready to defend themselves.

It's a fine line between lawfulness and anarchy....there is a level of distrust that has grown and when you CHOOSE to blame one side for that distrust it is YOU who is not seeing the problem.
 Quoting: FeedYourHead

And after those situations you are like
"Meh, it's fine" ?

....
Ok....then...
shrug
Nothing I can say next to those experiences
 Quoting: Anonymous Coward 77645551

Where the HELL did I say, "It's Fine"? Obviously you have reading comprehension problems...

Point is, the place to fight "rights" battles is NOT in the street with people who have guns...regardless how right you may or may not be but my thoughts went to how we have gotten to where we are.

People who only see the problem as being ONE SIDE causing it are either just lazy, ignorant or just refuse to see the truth. I offered that truth in the first post of mine in which you replied but you chose to overlook it and instead blame one side only. So which of the above categories above do you fall into?

So, just how quickly can things change for a cop in a seemingly normal situation?

This quickly;

The next phase of the police state took place under Obama and everyone seems to gloss over that fact.

He doubled the allocated resources for police, essentially doubling the amount of police out there and made hiring ex military the norm.

Ever notice why all of a sudden 2 cars pull peopl
over?

Then Trump allocated the use of military weaponry by police.

There will NEVER be law enforcement reform and people justifying shit like this is part of the problem-they are lawless scumbags who's purpose aside from policing the sub-society of the inner-city, where most people DO NOT live, is to generate revenue & stimulate the prison industrial complex.

Its all part of the plan

The Police Force across the Nation have been militarized against We The People. They view each and every one of us a scum to be subjected and held down under their Jack-BOOT.

Cops are NOT properly Trained
Cops are NOT Trusted
Cops are NOT held Accountable
COPS HAVE ZERO Common Sense
Cops are a clear and present danger to the populace at large with their massive egos, roid rage and most are Drunk on Power and display the Arrogance of Power.

Cops are not held accountable by the judicial system, they are given cover from any accountability and are infamous for Citing, “ qualified immunity”, the legal doctrine that shields officers from liability.

It is the POLICE FORCE, most are roided up freaks in a Police pursuit rage , .. If You Run, You're Done. Cops Go Berserk When People Run From Them or even question their unreasonable demands, and Police pursuit rage is an overlooked factor in recent stories about brutal cop encounters with citizens.

The cops jump out of their car over a minor traffic violation screaming, “Get on the ground! Get on the ground!”

They use the Prone Out Position on regular Joe's.

One officer explained to the Independent Commission of the Los Angeles Police Department how elements of the LAPD use of the “prone-out” was “pretty routine” as a way of intimidating the targeted public and imposing a proper attitude of contrite submissiveness. According to that officer, “aggression and force are the only things these people understand.”

Then when the bastard kills you he uses Qualified Immunity, this is the trick the cops use to shirk any responsibility. **** Recall, Repeal, Impeach, file Suit *** There are actions that can be taken to curtail this unacceptable behavior by our Civil Servants.

*** I think many of us have become so docile and subservient to police we forget that we do have a right to fight back if attacked (even against police officers) in unlawful arrests.

“Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John B...ad Elk v. U.S., 177 U.S. 529.

Besides self-defense is a natural right, stemmed from the root of all rights, self-ownership. When someone tries to hinder your ability to own yourself through brutal oppression and violence, it is not only your right, but your responsibility as a free individual to resist.

I will say it again... Cops are not held accountable by the judicial system, they are given cover from any accountability and are infamous for Citing, “ qualified immunity”, the legal doctrine that shields officers from liability.

** Excited Delirium ????????????

BTW, there is a VERY THIN BLUE LINE between a civilized society and one in total anarchy. The Cops have betrayed our TRUST and have compromised their Office with Dangerous and STUPID acts like the ones in the video above. They have created this TOXIC Environment.

They broke it, they need to fix it.

Don't really understand why assholes think shouting in the street is the proper way to handle situations. The garbage stick is a potential weapon and the guy should have put it down. If the officer had reasonable suspicion to investigate or was called by a complainant to investigate, he had a legal obligation to do so and could not just walk away from the situation. If the citizen did not like the way he was treated he has the legal remedy of filing a complaint with the department, which they then have a legal obligation to investigate.

You coptards always blame cops for following laws and protocols that you don't agree with without considering that those laws and protocols are legislatively put into place by your state and local representatives. I guarantee that the vast majority of you couldn't eve name your city or state reps or state senators if your life depended on it, let alone know anything about their voting records with respect to police protocols. So much easier to jump onto a computer and squeal like scalded dogs than to engage your civic responsibility and hold your local and state reps to account. You get the government you deserve. 16-3-103. Stopping of suspect.

(1) A peace officer may stop any person who he reasonably suspects is committing, has committed, or is about to commit a crime and may require him to give his name and address, identification if available, and an explanation of his actions. AThe stopping shall not constitute an arrest.

That statute defines the grounds for legal detention. If the officer had proper reasonable suspicion or was directed to investigate a complaint, he is legally obligated to see the investigation thru to its conclusion. Yelling at him doesn't change that.

The link you posted proves me correct.

Re: Cops draw guns on black man picking up trash on his property
Trash dude should have been more respectful and just given a proper ID to the officer as he was ordered to do

but, these days black people think it's cool to talk back and argue with cops

then they wonder why they get shot, beaten, or tased

And after those situations you are like
"Meh, it's fine" ?

....
Ok....then...

This quickly;

Granted, I may have mis-read you.

Maybe I'll put this another way or two.

I'm not even specifically blaming police. Hell, I wanted to be a cop myself. Was accepted to. Then I had the thought of what if I'm partnered with a bloke like the above, or worse? The rule in the police brotherhood is you cover for each other...I wouldn't have lasted long because I take any oaths very seriously, and it didn't include covering for people who shouldn't have the badge.
Policy makers dictate how cops operate, and current policy is every citizen should be considered a threat, and treated as such. Kind of like soldiers in an active war zone, no? The fact that politicians, police, and a lot of your citizens are not only fine with this, but cheer on such actions is beyond disheartening and history yells where such actions inevitably lead.

As for standing up to people with guns...
1776.

You guys won a war against a global superpower because it's police (redcoats) were abusing people based on the authority granted to them. (Yes other factors also)
Now...where are you currently?

Sometimes burglars and other criminals do things like that , to appear harmless while doing something illegal

True, but we're not living in Nazi Germany. Cops just can't stop anyone at anytime for any reason and demand we show them our papers.
