Don't really understand why assholes think shouting in the street is the proper way to handle situations. The garbage stick is a potential weapon and the guy should have put it down. If the officer had reasonable suspicion to investigate or was called by a complainant to investigate, he had a legal obligation to do so and could not just walk away from the situation. If the citizen did not like the way he was treated he has the legal remedy of filing a complaint with the department, which they then have a legal obligation to investigate.

You coptards always blame cops for following laws and protocols that you don't agree with without considering that those laws and protocols are legislatively put into place by your state and local representatives. I guarantee that the vast majority of you couldn't eve name your city or state reps or state senators if your life depended on it, let alone know anything about their voting records with respect to police protocols. So much easier to jump onto a computer and squeal like scalded dogs than to engage your civic responsibility and hold your local and state reps to account. You get the government you deserve. Coptard FAIL!

Not even if he held several guns is he required to obey that dumb cop. Hypothetical situation. I am in complete compliance with the law, on my own property or in my car, armed, and a roided up cop with history of abusing citizens pulls his weapon and is demanding I disarm.
m I required to follow his orders?

You see, the way I read the Constitution no person is above the law and all laws have eual force on every person. Point gun at me and is it is aT aLL POSSIBLE, I will end you as is my right under the law in dealing with deadly imminent threats

Uh, the supreme court has ruled you must produce id if asked by the dognut brigade.
 Quoting: Anonymous Coward 58840360

Bullshit, in fact they have ruled the exact opposite. You show me where The Supreme Court ruled that I'm required to show id merely because a cop asks for it? Show me that ruling.

They must have reasonable suspicion that you have committed or are about to commit a crime and they have to articulate that crime.

You have no duty to provide them with id merely because they want to see it or because they ask for it.

Sure, pay particular attention to the part in red, because without reasonable suspicion of a crime you are under no obligation to provide id. In fact without reasonable suspicion of a crime they can't even "legally" detain you. Learn your rights people or they will be taken from you!

Hiibel v. Sixth Judicial District Court of Nevada, 542 U.S. 177 (2004), the Court reasoned that a state statute can require a suspect to disclose his or her name in the course of a brief stop, if the detention was based on reasonable suspicion of a crime. Therefore, if state law requires identifying yourself to an officer, refusing to answer a request for one’s name during a stop could lead to an arrest.

The guy did not cooperate with the officer from the start.
He could have put down the bucket and stick like he was asked to but no, he had to play the victim card.

We live in free country you dipshit. Only a stupid Liberal would bow down to the almighty cop who is violating his civil rights.

We are free to pick up trash on our own property without being harassed and we certainly don't have to provide papers proving were we live. Only a stupid Liberal would comply with this bullshit because they don't care about freedom and rights.

I would ask him if "suspicious" as a felony or a misdemeanor? And to please state the penal code of "suspicious" You see, suspicious is not a crime.

Then I would ask him if I'm being detained. If he says no I would walk away. If he says yes I would ask him what crime do you suspect me of committing officer? Once again, suspicious is not a crime.

If he'd kept his mouth shut and they had arrested him, he had multi million dollar civil rights lawsuit and that is how you bet the fuckers because the bottom line for any police department IS about creating revenue for the jurisdiction, not losing millions of dollars

That's all well and good but what happens when that rogue cops shoots and maims someone and they're rushed to the hospital and rack up a Million plus in medical bills.

Now, that person can't sue the city to recover their medical bills, pain & suffering etc and you know the cop doesn't have even a fraction of that much money or he wouldn't be a cop.

I think I'd prefer them working for the city.

and put him in prison for a mandatory life sentence for color of law criminal oppression. If people in a town dont want to get sued let them complain about the crooked, violent self entitled and self aggrandizing cops so they re gotten rid of.

Sometimes burglars and other criminals do things like that , to appear harmless while doing something illegal

For all this officer could have known, this guy could have been there casing the place

Actually, in most states they CAN, legally

even if it's not legal, it's better to comply . Show your ID, explain yourself, then be on your way

Or, you can be one of those "I know my rights!" idiots and escalate things, then end up dying from a restraint hold or being tased.

the choice is yours

Re: Cops draw guns on black man picking up trash on his property
you know its not just cops in the USA that do stupid shit, in 2010 we had a dispute with our next door neighbour, they were a bunch of bullying dickheads, they cut cables to cctv cameras that we had put up 5 years before, so we had some problems with them, now you know we cant have handguns in the UK, and rifles are difficult to obtain due to the strict firearms laws, now at the time and I still have I have a shotgun license which only allows me to obtain shotguns that can hold no more than 3 shells (pump and semi auto) I have a semi auto and a over and under.
I also have several air pistols and 2 air rifles. The police here in the UK dont carry weapons instead we have firearms response police officers, who have 9mm Glock pistols strapped to their hip and 9mm HK or similar rifles in a locker in the patrol car.

OK I was just setting the scene................

it was Friday night and I was cleaning one of my CO2 bulb powered air pistols a Smith and Wesson 626 look alike by Umerex of Germany, it was quite expensive it cost me £265 in 2006, the pistol was in bits on a coffee table in the living room on a white towelling cloth, gun oil grease and couple of tools, my 2 kids were in the house watching telly, the wife had gone out. There was a loud knocking at the door and upon opening it was a local beat cop, asking if we had seen any undesirables hanging about as someone on the estate had had there mountain bike stolen,I invited him in, and after a minute he spied the air pistol on the table.....he asked what it was and I told him it was an air pistol, I then went over to the frame to show him the the CO2 .177 air pistol written on the barrel, when he commanded me to stop, and insisted on calling the firearms sqaud the check the gun out.......bemused I listened to him on the radio.
Now at the time I lived in Middlesbrough on the North East coast of England the 2 firearms patrol cars were both at a ton called Peterlee on the same coast further north a total of 21 miles away these 2 cops raced down the A19 one crashing at over 100mph and the other kept going, when they arrived at our home with hands on guns they inspected the air pistol, proper pissed off because presumably they had wrote off a BMW X5 3 months old patrol car..... I did not know this at the time.....they then wanted to take my air pistol off me, but I soon put a stop to that after I told them they were legally owned air pistols and they just made themselves to be total jerks

The bigger story here is that a brother was picking up trash instead of littering.
 Quoting: Anonymous Coward 58840360

I've found Hispanics do most of the littering.

They'll throw big parties in the park and just leave the trash laying on the ground, while the trash barrels nearby are empty.

They even leave dirty diapers from their spawn all over - parking lots are littered with them.

It's even worse down in Mexico and Central America -- you can go to the most beautiful places and trash is strewn about all over

It's like it's in their blood to litter -- along with rape and violence

Then the cops sez you are suspicious. Now what? Gonna get beat instead of just cooperating?

Then if you have a problem with how you were treated you hire a lawyer and file a complaint. if its all on video, like the guy knew it was, you shouldn't have any problem proving your case. Or you can be an idiot and start a shouting match from your front lawn with a potential weapon in your hand with 8 cops who's guns are drawn.

did they think he was stealing that trash?

Sometimes burglars and other criminals do things like that , to appear harmless while doing something illegal

For all this officer could have known, this guy could have been there casing the place

True, but we're not living in Nazi Germany. Cops just can't stop anyone at anytime for any reason and demand we show them our papers.
 Quoting: Anonymous Coward 52055181

Actually, in most states they CAN, legally

even if it's not legal, it's better to comply . Show your ID, explain yourself, then be on your way

Or, you can be one of those "I know my rights!" idiots and escalate things, then end up dying from a restraint hold or being tased.

the choice is yours

In any state they can ASK to see your id but you are not legally obligated to provide it unless they have reasonable suspicion that you have either committed a crime or you are about to commit a crime. They also must be able to articulate said crime. Learn the law, The United States is a free Nation. We're not living in Nazi Germany.

Legally, they can not even detain you unless they have reasonable suspicion that you have or are about to commit a crime. You do not have to id yourself just because they ask (or demand for that matter). Learn the laws people. Learn your rights or they will take them away.

Being detained by a police officer in The United States of America who has no reasonable suspicion that you have either committed a crime or that you are about to commit a crime is a violation of your Fourth Amendment rights. They are illegally seizing your person.

They are dumbing you down so you don't even know your rights (success on their part with you) and they want to make you not care when your rights are violated (another success for them with you).

This way when they take away your rights you won't even care or notice. Perhaps you'll even vote them away. Dumb down each generation dumber than the last, that's how they're doing it.

Learn your rights and don't let them violate them or they will take them away.
