Executive Orders
Hopefully someone on here can enlighten me.

Per the constitution, congress passes laws. The executive branch executes them. That means all Executive Orders should be written on how to implement current law.

The EO that President Trump wrote that allows confiscation of assets seems to me to be more like a new law. I love the idea, but I can't figure out the legal basis that lets him do it.

Can anyone explain either precedents or other rulings that would justify it??? TIA

It'a an EO instructing the DOJ to include those penalties.

But if the penalties were not listed in the original law how is it legal? Or were penalties listed but not defined in the law? That would make sense.

It just makes me uneasy. It feels like POTUS just decided to do something without a defined authority. It is the type of thing that could escalate if the dems ever get the office back. Thanks for the input.
