I’ve been on both sides of these situations and can honestly tell you that 99% of officers do not go about singling innocent people out for no reason. In this case, the officer is clinching his bag, which makes me think that there is a possibility they have suspected he stole something.... From either, where he went to eat, or from somewhere previous. Anyway, this is where it gets interesting... In most states, usually in retail stores, undercover Johnny rent-a-cop, who is not obligated to the same regulations and protocols of the police can seize your personal belongings on site... No badge shown, no Miranda rights, nothing. But if those rent-a-cops are wrong, a good lawyer can charge them with such crimes as kidnapping, if detained, and not able to prove their case. Uniformed Police officers have more wiggle room for detaining people, but not allowed to sieze any items without reasonable suspicion. Hope this helps. |
