As far as arresting a legislator goes, the law specifically is "The Senators and Representatives...shall in all Cases, except Treason, Felony, and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same..."

ARTICLE I, SECTION 6, CLAUSE 1

So you'd have to prove passage of the law is a felony, breach of the peace or treason, and it's actually a bit of a stretch, but I suppose treason would be the best charge to go after, but I'm doubting it would stick. The definition of treason is:

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

They have a lotta leeway in the health, safety and welfare latitude. So, I don't believe law enforcement or the courts are likely to arrest them for passing laws. The people are going to have to explain to the representatives how much they don't want this and that it will go bad for them if they pass it.

Now, on the other hand, you can seek an injunction to prevent enforcement of the laws while you present an excellent argument that they are unconstitutional. Then it's gonna depend on the SCOTUS, because that lawsuit, if it's well-crafted, really will go all the way up to the Supreme Court.

People don't realize that it's just as important to keep an eye on your local judges as your legislators.

There will be lawyers willing to take this on pro bono. You just have to pick the right one. I'll take on cases like that myself in my life time. It's just part of the job. I can't do it because I'm a law student and not licensed in Virginia anyway, but someone will.

The real option would be for sheriffs of all counties that disagree to get together once Northam signs. But then it is like one guy with a gun holding a crowd at bay. Except the scope of this goes well beyond Virginia. Folks from several states away are prepping to go if shtf. Not everyone has 'kids' btw.

You just need an army of lawyers. The problem is most of them are in a club and will want to practice law after it is over. So one of them will sell you out some how.

I'm not from Virginia, and I don't see the people on the East Coast backing down or being pussies. In fact, I'm prepping for the worst. I was just answering a legal point. I'm from California and likely to have milder language even when speaking in favor of Second Amendment rights, which I am highly in favor of.

I'll agree with some other posters here though that our legal system is screwed. And it's unlikely that an injunction against enforcement would be granted before the 20th, so anything could happen.

It would be nice to see a peaceful resolution that maintains our Second Amendment rights. That's always the preferred option, because when you fight to retain freedom, you run the strong risk of not being able to live to enjoy it :( It's a last resort, as it should be.
