It's pretty simple -- you hold a weapon in the presence of a police officer -- YOU GET SHOT

these men and women need to go home safely to their families each night

any decent person can understand why this man was shot

and it's his fault -- he FUCKED UP

you do NOT answer a cop's knock on your door with a firearm in your hand
 Quoting: Anonymous Coward 69461627

SInce holding a gun is 100% lawful, that would be nurder, wouldn't it?

Explain the legal theory that give the police the right to shoot a citizen because he is holding a gun. DO I have the right to shoot them because they are holding a gun?

I can't find it. I know if I do what they did I go to prison. DO police have special rights I dont know about?

Pussy.

Hopefully it's you next time.

Dont try to protect your house. Just let anybody come knocking at your door at 2 in the morning.

JUST COMPLY OR DIE.
 Quoting: Anonymous Coward 79022003

Knocking on someones door at 2:am is not illegal. Brandishing a firearm on public property (in the hallway) is. Do it in front of officers coming to investigate a possible domestic abuse situation and you might get shot over it. I hate how it turned out, and I think training by both could have prevented it. But the victim broke the law and was seen as an imminent threat with deadly force and intention (or why would it not be holstered) to use it. That observation was correct. It's a shame the victim didn't have time to explain himself, but when you brandish deadly force on public property time to explain yourself isn't guaranteed by US law, or the Constitution.

Lots noise is used as a torture tactic, like in Waco by feds.
Anyone constantly abusing neighbors peace deserve to be shot.
It was already sundown so the noise needs to go down too.

In my small town any noise heard beyond your own sidewalk gets you a 3rd time noise disturbance $600 fine.

People can't turn silence up so the noise must be turned down or this can happen.

I don't blame the cops either, they have their own children that they need to go home to at the end of their shift.
 Quoting: Anonymous Coward 76538212

Personally, I don't see how that is the complaining neighbor's fault. Maybe they were unreasonably noisy. I would have complained, too.

After any shooting incident all cops involved should be immediately drug tested.
 Quoting: Anonymous Coward 9073453

If they truly serve their community, and you know they already get two weeks paid time off after this, it would be logical for them to submit to voluntarily receive drug and psychological testing while remaining under observation. The community must be reassured they don't have a trigger happy madman roaming freely among them. The thing most important, The Jury and NOT A JUDGE, shall decide if The People require charges be brought against the officer in question. If can all happen within the two week observation period! This would stay true to the spirit of a government that's at it's core, BY THE PEOPLE, FOR THE PEOPLE, AND OF THE PEOPLE

I hope some political types with influence or potential are listening to me here. Because this will end in revolution if we don't update our system to truly reflect the Spirit of Truth and Freedom! If we value Good over Evil, let's shine that light for the whole world to see!
 Quoting: Anonymous Coward 56514037

I want to also point out that no cop is gonna want to be under observation in a hospital/psychological review place. It won't be fun, they'll still get paid, but it will deter them from shooting people that they don't have to, and it will also be seen as a reassurance to the community that they have The People's best interest at heart. Self sacrifice and service, if they're in it for any other reason then they shouldn't be law enforcement officers!

He didn't put his "hands" up. He put ONE hand up, that wasn't the one holding the weapon. He should have dropped that weapon, and showed the cops his shoulder blades with his hands are far away from the weapon as possible.

He wasn't on his property. The hallway is public property.

He wasn't "answering his door", or he would have been inside. Look at his feet.

He didn't just "open the door". He jumped out into the hallway. Again, look at his feet and body movements. He displays aggression.

"Exited the apartment" is where he messed up. If he just would have stayed inside and not jumped out into the hallway he would probably still be alive. RIP bro. I hope a lot of learning and training comes from this situation.

That's right. It is a lie that he pulled a gun on them as it was already pulled when he answered the door.

wtflol
 Quoting: eatinmraw 41033436

He never pointed it at them.
It was pointed at the ground and he dropped to his knee with his left hand out and dropped the gun on the ground with his other hand.

Cop in front never shot.
Why would that be?
 Quoting: Anonymous Coward 78101959

Cop in front of him didn't see the gun as it was behind the dead man. Cop in back could see the gun and that split second of bravado from the video game superhero got him killt.

DC-word2
 Quoting: eatinmraw 41033436

Cop in front clearly backed away and scooched towards the wall.

It's sad that the cop that shot him in the back is even allowed to be a cop.

And they stick together like gang members and that's another problem.

He lied for his buddy in his account of events like they all do.
 Quoting: Anonymous Coward 79243061

Luckily in this case there is very good video evidence with audio. I doubt any charges will be filed and if they are I don't think they'll stick. The law is the law. Unfortunately in this case the victim wasn't familiar with the law. TRAIN People. Get professional instruction about good decision making while in possession of deadly force.

The way you determine whether or not these shootings are lawful is ask yourself this, if you had done the same thing the cops did would you be arrested and charged with homicide.

The problem is since 911 the POLICIES of using deadly force against citizens have greatly exceeded lawful authority.

It used to be if a cop shot a person that didn't shoot at him first he was charged. PERIOD

I remember those days, it wasn't so long ago.

I hope that isn't a lawyer. If it is I wouldn't hire him.

Mostly by posting legally accurate information (what you've called "spam") I suppose.

I don't hate the police but I don't kiss their ass either. Part of the problem is their "Bullet Proof Warrior" mentality.

What about citizens supporting their right to carry that want to go home to see their kids every night? Do they matter?

You can be in your home with a firearm in your hand. Just not in a public hallway taking an offensive posture toward law enforcement officials with an unholstered firearm.

The hallway IS NOT PUBLIC, it is on PRIVATE PROPERTY.

Idiot

No, I apologize but that isn't accurate. I could occupy that hallway and just as much legal right to do so as the anyone who lives there, the officers, a salesman, or anyone else.

Private property is required to be marked as such. Any apt complex with that requirement has gates. Didn't look like an apt complex with a gate to me. Maybe. Still, the victim doesn't own the property and therefore doesn't have the legal right to brandish a firearm in the presence of law enforcement officers.

The hallway in an apartment complex is PRIVATELY OWNED, the whole building is.

When the police entered that building they entered the dead mans rented property, the hallway being a part of it he is legally allowed to occupy. The difference between him and a "salesman" is no one can tell him to get off the property.
