D.C. Court of Appeals rejects Michael Flynn's effort to have charges dismissed

The D.C. Circuit Court of Appeals ruled 8-2 against dropping the charges against Mike Flynn

D.C. federal appeals court Monday rejected former National Security Advisor Michael Flynn's effort to have a judge dismiss the charges against him. The court overturned an earlier decision that would allow the Justice Department to drop its case against the retired Army lieutenant general.

The decision was made in an 8-2 ruling from the D.C. Circuit Court of Appeals. Flynn and his attorneys had asked the court to intervene and force a district court judge to grant the Justice Department's motion to drop the charges against Flynn. Instead, a judge will now be allowed to scrutinize the DOJ's request to dismiss the charges.

In June, a three-judge panel ruled that District Judge Emmet Sullivan must dismiss the case against Flynn - per DOJ's request.

Let's first be clear about what this ruling today means:

It DOES NOT MEAN that the DC Court of Appeals just affirmed that Sullivan is a legitimate party to the case, and that he can appoint his own amicus curae 'prosecutor' to search for new charges against Flynn.

1) order Judge Sullivan to dismiss the case

or

2) replace him with another judge to handle all further rulings on the case.
