- If the President and the Senate are controlled by different parties, a catfight ensues.

The fact that Justice Scalia was declared dead by phone, by a justice-of-the-peace (not a doctor of any kind), and buried without an autopsy was a dead giveaway, pun intended.

As I understand it, the President has another Trump card up his sleeve:

All he has to do is nominate his choice; then, Mitch McConnell simply recesses the Senate in which case Trump's new Justice assumes office on a TEMPORARY basis until such time that the Senate is reconvened and the confirmation process can proceed.
