If there is election fraud and the State legislature determines it's a failed election because of it, they appoint the electors to the candidate that won based on the evidence they formally have been given. It's the legal and Constitutional role to do so. There is no legal dispute over that. They are just cowards and won't do it - complicit in the coup. The question is, has the Trump legal team formally presented the evidence to these legislatures? Regular courts are not the proper venues to be giving this evidence - nor is the media. It may turn out that the only thing Trump's team has been engaged in was a charade if they haven't given these legislatures formal evidence. |

At least any delegation is always non-binding By this argument Congress could pass law saying someone else makes laws on something say climate They can't do that ... It's not the judiciary's role to do so. A judge that rules on such a case for fraud in a Presidential election where the outcome of the vote is changed will be sued into oblivion and removed from the bench because it's not his or her legal and Constitutional role to adjudicate these issues and decide them. They can rule on electoral processes - which is all the courts have ever done. It's only the State legislature's role to decide these cases and weigh the evidence formally presented to them. That's what everyone is waiting for. |
