Can I REFUSE a COVID test?

Right on the FDA website it says that the test is not approved. Show them that.

If they already sent you all home for emergency quarantine, can you just request that they let you stay home for 14 days and come back without a test? (You might not get paid for those days out, since you weren't proven to be sick / medical reason.)

Here's the argument: If you test positive, you'll have to quarantine for 14 days anyway, right? So just volunteer to quarantine anyway. Should be the same difference in the end, don't you think?

And a couple days ago, a Portugal court determined that PCR is not reliable, thus forced quarantine is not legal. (Paraphrasing, something like that.)

Look for that thread here on GLP. Maybe you could glean something from there.

If nothing else, I always try to slip in that "you're going to be on the wrong side of history on this," which really annoys people. Show them that other countries are figuring out the PCR failings, and you're not convinced we should participate until it's settled.

Yes but that was a long time ago, I don't think there were previsions in there about my rights during a pandemic, but its still a good idea to check what the companies policies are.

OP, get a meeting with a lawyer or just call one and ask what are your reasonable ways out of this?
You can always threaten then with suing, im sure there is no way in a free country like USA for your trial to lose. there are so many reasons for you to not accept this draconian pressures.

It sucks having to make the choice between having to get tested ( we all know how inaccurate and rigged thet are) and worrying whether you'll get false positived, or losing your job if you refuse.


It's bad enough so many people are forced to wear masks and have their temperature taken just to keep their jobs. As bad as mandatory masks and temperature checks are mandatory testing and vaccines are much worse.

Lets us know OP the development of your story and what the lawyer recommends. Im lucky to be self employed so I dont have to worry about these things tho im pretty sure i would have been jobless in this times.

You might have a disease, what court case can you cite that will support you being fired for having a disease or virus? People have to fight, it may not be the one you want.

some people who have had the vaccine (they are the ones in the clinical trials) say that they got side effects after their vaccine injection, they say their arm hurts really bad and also they get a flu for a few days.. guess this is the way it works. so because it leaves you with uncomfortable effects, since you have to get a 2nd shot with the Phizer vaccine, the side effects might make people not to want to go for the 2nd necessary vaccine.

so be prepared for side effects.

As a contractor with the federal govt., I can refuse a test but then they impose on my company to instantly replace me since I am no longer qualified to be on site. It's just like being active duty except you can be instantly fired with zero appeal recourse.

Just got back from walk in clinic for bronchitis. They asked all the usual dumb covid questions and asked me if I have been tested. They never once suggested that I should be tested.
I will never do it.

If suspecting people may have an infectious disease and they need it proved otherwise is in your contract or anything with complying with company policy is then no you cant refuse. They may just suspend you for two weeks without pay. Get the test if its positive then time off for 80% pay if neg then all is where you where. Whats your problem. You already have a ss number... Unless you need to keep your dna off a database due to past unsolved serious crimes then why fight it.
