Authorities are usually very reluctant to charge athletes with assault for incidents that happen during games, but what makes this case different is the guy had been ejected from the game before he attacked that referee, which means his status was no different than a fan in the stands charging the field. He should be arrested, and since it's Texas, I think he probably will be, but yeah, he should have been arrested by whatever police were there at the time.
