That is not true. Pelosi is second-in-line for succession to the presidency. It does not follow, however, that she is first-in-line for succession to the vice presidency.

Succession for the vice presidency is addressed in the 25th amendment, section 2:

"Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress."

What is unclear, though, is who would *act as* VP (and thus, president of the senate for the purpose of applying the 12th amendment) prior to confirmation of a replacement nominee. I.e., would the president's nominee for VP become acting VP until they are confirmed? This does not appear to be addressed in the 25th amendment. Perhaps any business requiring the VP (such as counting the electoral college votes), would simply have to be postponed until a VP nominee is confirmed.

It looks like this point is addressed in Article I, Section 3, Clause 5:

"The Senate shall chuse their other Officers, and also a President pro tempore, in the Absence of the Vice President, or when he shall exercise the Office of President of the United States."

"Pro-tempore" is a latin phrase meaning "for the time being". So it seems that in the absence of a confirmed replacement VP, the Senate would simply choose someone to be acting president of the senate, who would then carry out the duties outlined in the 12th amendment.

Chuck Grassley actually is President pro tempore of the senate currently, so I guess he would count the votes if Pence were to vacate the office and there was not a confirmed replacement on Jan. 6.

At this point the only way Trump can stay in power is to get his hands wet.
