Justice Thomas: SCOTUS Refusal to Hear Pennsylvania Election Cases Is 'Inexplicable'
The Supreme Court ruled 6-3 to reject the review of two 2020 Pennsylvania presidential election cases Monday, but Justices Samuel Alito, Neil Gorsuch and Clarence Thomas believe they should have been given hearings.

In his dissent Justice Thomas argued mass mail-in voting, which was conducted in Pennsylvania for the first time ahead of the 2020 presidential election in November, combined with election rules being rewritten last minute, makes the process prone to fraud and mistrust.

"The Constitution gives to each state legislature authority to determine the 'Manner' of federal elections...Yet both before and after the 2020 election, nonlegislative officials in various States took it upon themselves to set the rules instead. As a result, we received an unusually high number of petitions and emer- gency applications contesting those changes. The petitions here present a clear example. The Pennsylvania Legislature established an unambiguous deadline for receiving mail-in ballots: 8 p.m. on election day," Thomas wrote. "Dissatisfied, the Pennsylvania Supreme Court extended that deadline by three days. The court also ordered officials to count ballots received by the new deadline even if there was no evi- dence—such as a postmark—that the ballots were mailed by election day. That decision to rewrite the rules seems to have affected too few ballots to change the outcome of any federal election. But that may not be the case in the future. These cases provide us with an ideal opportunity to address just what authority nonlegislative officials have to set elec- tion rules, and to do so well before the next election cycle. The refusal to do so is inexplicable."

If there’s no such thing as a national election then why do we have the FEDERAL election commission? One would think you would need that for a national election no? The national election is the electoral college, every state goes in with their results from their state election and casts their electoral votes for their desired candidate. Ya dope.

Federal Election Commission, created 1975, is a perversion. Created by someone who thinks and believes as you do. Oddly enough created within a year of the near overthrow of the US Government in 1974, after Nixon resigned.

Sovereign States and their residents created the Federal System by signing the Treaty called the Constitution of the United States.

The Federal government does't decide anything regarding who goes to or stays in Washington. the idea that it does is a perversion.

Re: Justice Thomas: SCOTUS Refusal to Hear Pennsylvania Election Cases Is 'Inexplicable'
We have officially planted the flag in Clown World. The rationale and quasi logic could only be achieved by lawyers. Let me see if I can follow it: To raise a suit ahead of the actual anticipated act would not give the plaintiff standing, because it has yet to take place. By waiting until after the transgression has transpired, the Doctrine of Latches kicks in and the case becomes a moot point as too much time has passed.
We could bring in teams of mathematicians and physicists to try and identify the exact point of inflection where the case goes from before standing to moot point, or we could bring in some nine year olds to call someone out for changing the rules in middle of the game just using horse sense.
Congratulations America, last one out hit the lights.

You’re right the federal government doesn’t decide they just facilitate the means for conducting the national election, the states decide who stays in Washington in the national election ie the electoral college.

You mean these United sovereign States? Sovereignty does not imply that 6 states can disregard their own Constitution at the peril of the other 44 states that chose to adhere to the law. The states were expected to act in union, which they did not. The scotus is more concerned with appeasing the City of London, the Vatican, and Brussels than performing their domestic duties.
