Maybe someone should ask about the 24 pages in the arrest report that have been hidden from the public. It probably involves a minor, so rather than opening a big can of worms they're just trying to walk away.

Actually if you refuse to give up evidence against yourself that is your right, and there is no way on gods green earth they can convict you of DUI if you do refuse to give a sample or do a roadside sobriety test.

Thats why all states now have a mandatory drive license suspension for refusing to take the tests.

A good lawyer will tell you the ONLY way you should EVER give up evidence against yourself is if you KNOW your sober as a church mouse. There is NOTHING to be gained by "cooperating" if you're drunk, the suspension to your license and the conviction for DUI will cost you far more than a 6 month suspension, one that you can get an automatic work deferment for IF you are NOT convicted of DUI. In the event you refuse the tests, you are convicted of NOTHING. Any half way decent lawyer can get any charge they do try to bring thrown out in a pretrial hearing.

In other words if you're not drunk, take the tests, if you are DON'T.

No, it's not. There is no charge or conviction for refusing to give up your fifth amendment right. The license suspension has no legal conviction attached to it.

Refusing results in a CIVIL penalty, almost always a suspension. Some states like New York require a fee to get your license back, with others it's automatically re instated after a set period of time..

NEVER give up incriminating evidence against yourself willingly no matter what any cop tells you, it cannot possibly help your situation.

It used to be in many states that if refused to take the BAC test you automatically lost your license, at least for a while. But we can't have anything unpleasant happening to the beautiful, wonderful, liberal Mr. Springsteen, at least until he's killed a few people.

Just to point out, although Sandy Hook is part of the Jersey shore, it's a NATIONAL park, meaning FEDERAL laws apply. Hence, he had to appear remotely before a FEDERAL judge.

The BAC laws of any given state are irrelevant when a ranger stops and detains on Federal property.

On a side note, Jersey has draconian laws about starting campfires on beaches. Since Sandy Hook is Federal, the state law is moot and you can have bonfires there.
