This man had no gun and the police had no rational reason for believing he was a threat to them.

Since it is perfectly legal to have a gun, or even to be holding a gun, that in of itself is not a justifiable reason for deadly force.
And the fact that he had his hands up when they open fire kinda negated that argument.
