I read it...and your assessment on the surface is absolutely correct. Still, it will be the legal INTERPRETATION of the case that will open the door. This is how things work. Cases themselves are very specific, but it sets precedent...and that will allow things to move rapidly in the wrong direction until another cases is challenged, heard, and ruled upon. That’s a BIG window for fuckery.

At what cost? Usually someone has to die or become permanently injured for large legal payouts.

I studied the 4th amendment in law school. What you described is exactly how the left has eroded the constitution over time. They know it takes time, and they know rights are rarely restored, so they wait and play the long game.

Most people would be shocked at how many Supreme Court decisions are flat out wrong.

I don't care if the guy was certifiably insane. Neither the wife nor the cop had any constitutional right whatsoever to deprive him of his property without due process (they are destroying the 5th along with the 4th, by the way). THAT is as clear cut as it gets.

If he had any percentage of ownership in the gun (doesn't matter if the wife owned it too or if it is considered community property), then it is his property. Just the same as if he owned land or a car with her name on the deed/title as well. She would not be able to sell said property or give it to another person without his consent.

Just because the property in question is a gun is IRRELEVANT. It's more than irrelevant, in my opinion, due to the 2nd amendment's plain language.

On the national level, the government is corrupt to the core. Fortunately, most local jurisdictions are more sympathetic to the problems of the people. If the Feds come for our guns, they will have to depend on locals to do the foot work. Outside Commiefornia, finding a sheriff that will try to take away legally owned firearms could be quite difficult.

I agree with you...and likely most, if not all, also have family and friends who are gun owners. It’s a foregone conclusion that LEOs will NOT cooperate with a door-to-door gun grab.

The Left knows this, too. So how do they enforce this? This is what we need to speculate on and plan for.

They’ve shown a pattern before for compliance with their directives. It will be soft LONG before it becomes hard. Based on past initiatives, it will be in several steps, some simultaneous, and not necessarily in this order.

Pass legislation with a ramped up and robust buy-back.
Many will blindly comply simply due to societal pressures and not wanting to ‘break the law.’

Publicly shame companies who sell guns and ammunition at the retail level until they stop. (Already happening)

Demonize gun owners as ‘unhinged, supremest lunatics.’ (Already happening)

Encourage family/friends/neighbors to turn in the gun owners they know.

Seize gun registrations and sales records from retailers and FFLs.

Create a ‘domestic terrorist’ list on a nationwide database, available to TSA, FBI, and local law enforcement...allowing something as simple as a traffic stop to hold an individual, allowing their homes and vehicles to be searched and raided in VERY public fashion...further putting the scare into the public, resulting in more voluntary firearm surrenders.

Force an immediate halt to all domestic production of ‘banned’ firearms and ammunition calibers, as well as certain reloading supplies and cease all imports.

Apply pressure via the IRS, TSA, state DMVs, state and federal aid, etc. for everyone on the ‘list’ until they can prove they are weapon-free.

Heavily tax all remaining ammunition sales.

And so on....

Basically, they will squeeze as hard as they can, making it difficult and uncomfortable to continue on. What’s left will be labeled as ‘active threats’ and dealt with harshly via siege.

It’s not a stretch to see where all of this leads...but by then, the number of ‘resistors’ will be deeply reduced and heavily isolated.

There will be no mass, public outcry. In fact, most will BEG the Feds to ‘keep them safe.’

This isn’t red flag confiscation where a judge approves it. That is bad enough, but this is far worse. Under “community caretaking” , cops can enter a home for something as mundane as a leaking pipe. The fourth amendment would be totally out the window. When biden bans guns, they wouldn’t need a warrant. Under community caretaking, they could just start raiding people’s houses to take their guns. No warrant needed.

That is where this is leading, and why it is so alarming. They are trying to take away for first amendment, the second, and fourth. They’ll take away the rest by default.

You’re right...it does violate the Constitution. Under an appropriate system of checks and balances lead by those sworn to uphold the Constitution, it wouldn’t hold up.
