How can you be guilty of 2 counts of murder for one death? Serious question

for example, i remember people saying back in the early 90's that the prosecutors were overzealous with the charges against the cops who beat rodney king, charging them with intent to kill

and the jury was willing to charge them with excessive force, but they did not think the cops were trying to kill rodney king, so they had to vote not guilty as charged

ok, so here's how it works in most municipalities:

You can charge the person for 1st degree murder if there's evidence, but if you think you might not be able to get the jury to convict, you can file charges for the lesser crimes as well. In many municipalities, if you don't include the charges for the lesser crimes, you can't charge them again if they're not guilty on the first trial.

So, they just charge them with all the charges at once and let the jury sort it out.

But once sentencing takes place, all the lesser convictions merge into the highest one he was found guilty for, and they only sentence for the highest one.

So he is in fact only guilty of murder 2 then? That makes much more sense thank you!

If it was two differing things like nurder and arson then fine charge away but this MURDER 1..2...3...manslaughter 1...2 stuff is not appropriate.
